Withdrawal of Open Records Questions

NOTICE: Closure of four formal open records decision questions.

The attorney general has determined that, due to legislative action or current practice of this office in issuing open records letter rulings, it is unnecessary to render a formal open records decision on the following four questions for which the attorney general had given notice of its authority and intention to render a decision under section 552.022 of the Government Code:

ORQ-43 (ID# 99-131600) RE: Whether the identities and addresses of crime victims maintained by governmental bodies, including local police departments, the Texas Department of Criminal Justice, and the Attorney general's Crime Victims Compensation Division, are excepted from public disclosure by common-law or constitutional privacy.

ORQ-48 (ID# 99-131601) RE: If a governmental body seeks an attorney general decision under Texas Government Code section 552.301, and if the responsive information (or a portion of the responsive information) is confidential by law but the governmental body fails to raise or brief the exception, what is the proper role of the Office of the Attorney General in raising, evaluating or applying the confidentiality exception?

ORQ-52 (ID# 00-137141) RE: Whether an individual's social security number is protected from required public disclosure under section 552.101 of the Government Code as information considered to be confidential by law, either by statute or by constitutional or common law privacy.

ORQ-54 (ID# 00-137665) RE: Interpretation of the Seventy-sixth Legislature's amendment to section 11 of article 49.25 of the Code of Criminal Procedure as to the public availability of autopsy reports and photographs or x-rays taken during an autopsy.
