40 TAC §3.703
The Texas Department of Human Services (DHS) adopts an amendment
to §3.703, without changes to the proposed text published in the March
22, 2002, issue of the
Texas Register
(27
TexReg 2212).
Justification for the amendment is the correction of outdated citations
within the rule. The expiration of the Achieving Change for Texans (ACT) waiver
on March 31, 2002, renders state welfare control group language in the rule
obsolete. In addition, the citations relating to food stamp limits have been
updated.
DHS received no comments regarding adoption of the amendment.
The amendment is adopted under the Human Resources Code, Title
2, Chapters 31 and 33, which authorizes DHS to administer financial and nutritional
assistance programs.
The amendment implements the Human Resources Code, §§31.001 -
31.0325 and §§33.001 - 33.027.

The Texas Department of Human Services (DHS) adopts amendments to §§15.100,
15.450, and 15.619, and new §15.401 without changes to the proposed text
published in the March 8, 2002, issue of the
Texas
Register
(27 TexReg 1684).
Justification for the amendments to §15.100 and §15.450 and new §15.401
is to clarify the treatment of a fiduciary (financial) agent. If the client
is the agent for another person, the income and resources of that person are
not countable to the client. If the client has a fiduciary agent, the client's
income and resources are available to him, unless otherwise excludable. Justification
for the amendment to §15.619 is to clarify the time frame for rescheduling
a missed appointment for an application interview. DHS uses policy established
by the Social Security Administration for the Supplemental Security Income
Program for treatment of income and resources.
The department received no comments regarding the adoption of the amendments
and new section.

Subchapter F. IN-HOME AND FAMILY SUPPORT PROGRAM
40 TAC §§48.2721 - 48.2725
The Texas Department of Human Services (DHS) adopts new §§48.2721-48.2725,
without changes to the proposed text published in the April 5, 2002, issue
of the
Texas Register
(27 TexReg 2789).
Justification for the new sections is to help nursing facility residents
re-establish community residences. The inability to pay for relocation expenses
has been identified as a barrier for Medicaid nursing facility residents wishing
to transfer to community-based services. Nursing facility residents eligible
for Medicaid payments generally retain only $60 per month for personal needs.
If residents accumulate $2000 in countable resources, their eligibility for
Medicaid is jeopardized. The Transition to Life in the Community (TLC) program
will assist individuals making this transition by providing one-time or short-term
financial assistance of up to $2,500 to pay for costs like rent, security
and utility deposits, moving expenses, household items, and other moving-related
expenses. These funds are not intended to provide ongoing services or long-term
housing assistance. Eligibility for TLC funds requires eligibility for ongoing
services through a waiver or other community service program, in addition
to other eligibility criteria intended to direct TLC benefits toward individuals
who will be able to live in the community on their own income.
DHS received one comment in support of the new sections from the Texas
Council for Developmental Disabilities.
The new sections are adopted under the Human Resources Code,
Title 2, Chapters 22 and 35, which authorizes DHS to administer public assistance
and support services for persons with disabilities.
The new sections implement the Human Resources Code, §§22.001-22.036
and §§35.001-35.012.

The Texas Commission for the Blind is adopting an amendment
to §161.60, Statutory Authority and Scope, pertaining to rules in Subchapter
B of the chapter on appeals and hearing procedures, without changes to the
proposal published in the February 22, 2002, issue of the
Texas Register
(27 TexReg 1287).
The amendment updates the name of the program to which the rules apply:
Blind Children's Vocational Discovery and Development Program.
No comments were received regarding the proposed amendment.

The Commission is also adopting the repeal of and new §169.2, Public
Access to Information, Forms, and Documents, without changes to the proposal

The adoptions are the result of the agency's review of 40 TAC Chapter 169
under the requirements of Texas Government Code, §2001.039. The chapter
serves as the agency's rules for serving children with visual impairments.
The agency's review indicated that the rules still serve the purpose for which
they were adopted; however, the Commission has changed the program's name
and has improved the rules by adding cross references and making needed technical
corrections. All rules not changed during the review process are hereby readopted
without changes.
