10 TAC §1.12

The Texas Department of Housing and Community Affairs (the Department) adopts new §1.12, without changes to the proposed text as published in the April 19, 2002, issue of the Texas Register (27 TexReg 3297), concerning the Administrative Hearing Guidelines, and therefore, will not be republished.

This section establishes hearing procedures for Department programs and functions that have no federally or statutorily mandated or regulated hearing procedures specific to that program or function.

No comments were received regarding this new rule.

The new section is adopted pursuant to the authority of the Texas Government Code, Chapter 2306; and in accordance with the Texas Government Code §2001.039.

The new section affects no other code, article or statute.

This agency hereby certifies that the adoption has been reviewed by legal counsel and found to be a valid exercise of the agency's legal authority.

The Texas Department of Housing and Community Affairs adopts new §1.13, without changes, as published in the May 3, 2002, issue of the Texas Register (27 TexReg 3662), concerning the certification with certain laws prohibiting discrimination required of housing applicants and the sanctions for noncompliance, and therefore, will not be republished.

This section is necessary to comply with §2306.257 of the Texas Government Code, as added by SB 322, 77th Session of the Texas Legislature and as a result of enforcing this section, there will be the increased likelihood of affordable housing available to all free of discrimination.

No comments were received concerning this new rule.

The new section is proposed pursuant to authority of the Texas Government Code, Chapter 2306.

No other codes, articles or statute are affected by the proposed new section.

This agency hereby certifies that the adoption has been reviewed by legal counsel and found to be a valid exercise of the agency's legal authority.
