1 TAC §273.7, §273.9
The Texas Incentive and Productivity Commission proposes
amendments to §273.7 and §273.9, concerning the state employee incentive
program administration. The proposed amendments to the rules are being made
to reflect the modifications and to further clarify the definitions and code
provisions newly enacted by the 2001 Legislature.
Ed Bloom, Executive Director, has determined that when the rules come into
effect there will be no fiscal implications for state or local government
as a result of enforcing or administering the rules.
Ed Bloom has also determined that when the rules become effective, the
public benefit will be monetary savings, increased revenue, and improved services
as a result of the amendment to the rules. There will be no anticipated costs
to persons who are required to comply with the amendments as proposed. There
will be no adverse economic effect on small businesses as compared to the
effect on large businesses.

The Commission proposes the amendments pursuant to Texas Government
Code, §2108.004 which authorizes the commission to adopt rules.
The rule amendments to §273.7(i), Agency's Role, affect Texas Government
Code, §2108.037 by rewording the subsection for clarification.
The rule amendments to §273.9, Eligibility, subsection (b) and (d)
affects Texas Government Code, §2108.24 and is amended to clarify the
language in subsection (b) and to add language inadvertently omitted in subsection
(d).
§273.7.Agency's Role.

The affected agency may transfer savings attributable to
an implemented suggestion from the first
year
of the fiscal biennium
to the second year of the fiscal biennium.
§273.9.Eligibility.
(a)

An employee who is temporarily assigned by the employee's
agency to a group that is established for the purpose of developing process
improvements in that agency is not ineligible under subsection (a)(1)
or

] (5) of this section to participate in the incentive
program solely because of the employee's participation in that group.

(d)
Agency implementation prior to submission of suggestion
to the program. If an agency adopts a policy or procedure as a result of an
employee suggestion before the
suggestion is submitted to the agency
coordinator, the Commission may grant a bonus or issue a certificate of appreciation
to the employee or employees who made the suggestion if the agency coordinator
confirms that:
