Chapter 63. VICTIMS' ASSISTANCE GRANTS

The Office of the Attorney General (OAG) adopts amendments to 1 TAC Subchapters B, D, E, and F, §§63.11, 63.15, 63.17, 63.55, 63.73, and 63.81, relating to rules for administration of crime victims' assistance grants (VAG), with no changes to the proposed text as published in the July 13, 2001 issue of the Texas Register (26 TexReg 5167). Subchapter B, §§63.11, 63.15, and 63.17, define projects that are eligible to receive VAGs, expand funding levels, and clarify approved uses of grant funds, and expand the grant period. Subchapter D, §63.55 clarifies that a grant may be funded for a 2 year period. Subchapter E, §63.73 addresses the continuation of funding. Subchapter F, §63.81 addresses personnel matters.

Subchapter B. (Grants for Victim Assistance Coordinator or Crime Victim Liaison, §§63.11, 63.15, and 63.17).

Section 63.11 as amended would allow the payment of fringe benefits, travel and training for the grant paid personnel. Section 63.15 as amended would increase grant funding levels to $39,400 for each project. Section 63.17 as amended would allow grant funds to be used to pay fringe benefits, travel and training for grant paid personnel.

Subchapter D. (Grant Application, Scope of Grant, Approval, §63.55).

Section 63.55 as amended would clarify that a grant may be funded for a 2 year period.

Subchapter E. (Funding of Grants, §63.73).

Section 63.73 as amended would clarify that a grant will be reviewed to determine if funding for the second year is approved.

Subchapter F. (Grant Budget Requirements, §63.81).

Section 63.81 as amended would clarify that a grantee must provide fringe benefits, travel expenses and training for grant personnel.

Chapter 75. AUTOMOBILE CLUB

Subchapter B. REGISTRATION OF AGENTS

The Office of the Secretary of State adopts new rule §75.10 concerning an exemption for individuals selling a primary service that offers automobile club services as an optional feature without changes to the proposed text as published in the November 23, 2001 issue of the Texas Register (26 TexReg 9479).

Recently, cellular telephone service providers have added certain road assistance services as an optional feature available to purchasers of their cellular telephone services. The purpose of the new rule is to clarify that a seller of a primary service, such as: cellular telephone service, is not required to register as an automobile club agent if certain prerequisites are met.

No comments were received concerning the proposed rule.

The new rule is adopted under the Texas Government Code, §2001.004(1) which provides the Secretary of State with the authority to prescribe and adopt rules. The rule affects the Texas Occupations Code, §722.011.
