37 TAC §463.4
The Texas Commission on Fire Protection (TCFP) adopts an
amendment to §463.4, concerning application criteria for the Fire Department
Emergency Program (FEDP), without changes to the text published in the December
28, 2001, issue of the
Texas Register
(26
TexReg 10809).
The number of eligible applicants for FDEP funds is anticipated to increase
as the result of changing the requirement for participation in TEXFIRS.
The amendment to §463.4 changes the requirement for participation
in TEXFIRS from during the three months prior to the application to participation
at the time of application or an agreement to participate at the time of funding.
No comments were received on the proposed amendment.
The amendment is adopted under Texas Government Code, §419.008,
which provides the TCFP with authority to adopt rules for the administration
of its powers and duties and Texas Government Code, §§419.051-419.064,
which provide the TCFP with authority to administer the FDEP.
This agency hereby certifies that the adoption has been reviewed
by legal counsel and found to be a valid exercise of the agency's legal authority.
