Chapter 21. LOCAL HISTORY PROGRAMS

13 TAC §21.2

The Texas Historical Commission adopts amendments to §21.2, Title 13, Part 2 of the Texas Administrative Code, concerning the Grant Program for Historic Museums. This section is being adopted without changes to the proposed text as published in the November 30, 2001, issue of the Texas Register (26 TexReg 9707) and will not be republished.

These amendments will broaden the museum grant program process to include grants of more than $1,000 and for grants that may not need to include match money to quality. The public will benefit from these amendments through the creation of a broader range of educational museum programs at qualified institutions.

No comments were received regarding adoption of the amendments to this chapter.

The amendment is adopted under §442.005(q), Title 13, Part II of the Texas Government Code, which provides the Texas Historical Commission with the authority to promulgate rules to reasonably affect the purposes of this chapter. No other statues, articles, or codes are affected by these amendments.

This agency hereby certifies that the adoption has been reviewed by legal counsel and found to be a valid exercise of the agency's legal authority.

Chapter 111. RULES AND REGULATIONS OF THE BOARD

13 TAC §111.14, §111.25

The State Preservation Board adopts amendments to §111.14, concerning Events in the Capitol and Capitol Complex and §111.25, concerning Memorials/Monuments on the Capitol Complex, without changes to the proposed text as published in the August 31, 2002, issue of the Texas Register (26 TexReg 6526) and will not be republished.

The amendment to §111.14 is necessary to allow the agency more flexibility in providing public access to the Capitol and Capitol Extension for organized activities. The amendment to §111.25 deletes the reference to "Permanent Advisory Committee" as this committee has been abolished. The Board's current administrative rule prohibits the approval of any memorials or monuments on the historic capitol grounds. This amendment will expand the Board's flexibility for responding to legislative directives.

No comments were received regarding the proposed amendments.

The amendments are adopted under Texas Government Code, Chapter 443.007(b).
