Title 37, Part 13

The Texas Commission on Fire Protection will review and consider for readoption, review, or repeal sections of Chapter 405, Charges for Public Records, of Title 37, Part XIII of the Texas Administrative Code, in accordance with the General Appropriations Act, Article IX, §167, 75th Leg. and §2001.039 of the Texas Government Code.

Specifically, the following sections of Chapter 405 shall be reviewed: §405.1 General, §405.3 Definitions, §405.5 Charges for Providing Copies of Public Information, §405.7 Access to Information Where Copies Are Not Requested, §405.9 Format for Copies of Public Information, §405.11 Estimates and Waivers of Public Information Charges, §405.13 Examples of Charges for Public Information, §405.15 The Texas Commission on Fire Protection Charge Schedule, and §407.17 Billing Form.

As required by the above authorities, the Texas Commission on Fire Protection will consider, among other things, whether the reasons for adoption of these rules continue to exist. The comment period will last for 30 days beginning with the publication of this notice of intention to review. Comments on the proposal may be submitted in writing within 30 days following the publication of this notice in the Texas Register to Gary L. Warren Sr., Executive Director.

The Texas Commission on Fire Protection will review and consider for readoption, review, or repeal sections of Chapter 407, Administration, of Title 37, Part XIII of the Texas Administrative Code, in accordance with the General Appropriations Act, Article IX, §167, 75th Leg. and §2001.039 of the Texas Government Code.

Specifically, the following sections of Chapter 407 shall be reviewed: §407.1 Inscription on Texas Commission on Fire Protection Vehicles and §407.3 Historically Underutilized Businesses.

As required by the above authorities, the Texas Commission on Fire Protection will consider, among other things, whether the reasons for adoption of these rules continue to exist. The comment period will last for 30 days beginning with the publication of this notice of intention to review. Title 25, Part 2

The Texas Department of Mental Health and Mental Retardation (department) will review Texas Administrative Code Title 25, Part II, Chapter 403, Subchapter B, concerning Charges for Community-based Services in accordance with the requirements of the Texas Government Code, §2001.039.

The department believes that the reasons for initially adopting the subchapter continue to exist. The department notes that the subchapter was proposed for repeal in the March 16, 2001, issue of the Texas Register, with the contemporaneous proposal of a new subchapter governing the same matters. The department received substantive comments from stakeholders on the new subchapter and discussions with stakeholders about necessary revisions to the subchapter are in progress. The department anticipates resolving stakeholders' concerns in time to present the rules for adoption at the July 2001 meeting of the Texas MHMR Board. If time constraints prevent the new rules from being presented at the July meeting, then the department will opt to re-adopt the subchapter proposed for review (i.e., Chapter 403, Subchapter B).

The Commission is concurrently proposing amendments to this rule. As required by Tex. Gov't Code §2001.039 ( as added by Acts 1999, 76th Leg., ch. 1499, §1.11(a) ), the Commission will accept comments regarding whether the reason for readopting the rule with the proposed amendments continues to exist.

Adopted Rule Reviews

Texas Commission on Fire Protection

Title 37, Part 13

The Texas Commission on Fire Protection has completed and adopts the rules review of Title 37, Texas Administrative Code, Chapter 403, concerning criminal convictions and eligibility for certification. This review was conducted in accordance with the General Appropriations Act, Article IX, §167, 75th Legislature, 1997. Notice of the proposed rules review was published in the March 5, 1999, issue of the Texas Register (24 TexReg 1641). No comments were received regarding the readoption of this chapter.

As a result of the rules review, the Commission repealed §§403.1, 403.3, 403.5, 403.7, 403.9, and 403.11 effective May 23, 1999. The repealed sections were replaced with new sections dealing with the same subject matter. New §§403.1, 403.3, 403.5, 403.7, 403.9, 403.11, and 403.15 were adopted effective May 23, 1999, as published in the May 21, 1999, issue of the Texas Register (24 TexReg 3860).

Notice of Readopted Rule: The Texas Department of Transportation readopts without changes Title 43 TAC, Part I, Chapter 30, Aviation and Chapter 31, Public Transportation.

This review was conducted in accordance with the General Appropriations Act of 1999, House Bill 1, Section 10.13, Article IX, and Government Code, §2001.039, as added by Senate Bill 178, 76th Legislature.

The proposed review was published in the March 2, 2001, edition of the Texas Register (26 TexReg 1877). No comments were received regarding the readoption of these rules. The Texas Transportation Commission has reviewed these chapters and determined that the reasons for adopting them continue to exist.
