37 TAC §343.8, §343.9
The Texas Juvenile Probation Commission adopts amendments
to §343.8 and §343.9, concerning multiple occupancy sleeping units.
These sections are adopted without changes to the proposed text as published
in the December 29, 2000, issue (25 TexReg 12922) and will not be republished.
TJPC adopts this rule in an effort to alleviate some of the problems associated
with overcrowding in detention facilities while maintaining certain space
and supervision requirements.
No public comment was received.
These standards are adopted under §141.042 of the Texas
Human Resource Code, which provides the Texas Juvenile Probation Commission
with the authority to adopt reasonable rules which provide minimum standards
for juvenile boards.
This agency hereby certifies that the adoption has been reviewed
by legal counsel and found to be a valid exercise of the agency's legal authority.
