Request for Applications
Introduction:
The Texas Cancer Council (TCC) announces the availability of state funds
to be awarded to support the
Texas Cancer Plan
.
Funds will be awarded to the selected entity or individual that develops and
implements an effective plan to identify, seek and secure public and private
grant funds to enhance cancer control in Texas. This enhancement will be accomplished
by expanding TCC's ability to implement all four goals of the
Texas Cancer Plan
; primary emphasis will concentrate on expanding Goals
I and II,
Prevention Information Services
and
Early Detection and Treatment
respectively.
TCC emphasizes initiatives that prevent and reduce cancer for underserved
Texans. Initial funding will be awarded from December 1, 2001 through August
31, 2002 and the maximum amount will be $50,000 for that time period. This
is expected to be a multi-year project; however, the applicant must reapply
each year for continuation funds. Future funding beyond year one will be contingent
upon applicant's success. Success will be measured by the overall effectiveness
of the plan in securing grant funds for the TCC and/or TCC funded projects.
Purpose:
The purpose of this Request for Applications (RFA) is to solicit statewide
applications to assist the TCC in identifying, seeking, and securing public
or private grant funds to further the goals of the
Texas Cancer Plan
.
Eligibility requirements:
To be considered for funding, a Letter of intent must include a project
plan and proposed budget, and be submitted by an entity or individual that
will serve as the fiscal agent and legal contractor for the project. The lead
entity may be a governmental agency, educational institution, a nonprofit
organization, a for-profit organization or an individual applicant.
Letters of intent must be received in the TCC office by 5:00 p.m. July
31, 2001. TCC will acknowledge receipt of letters of intent in writing. Letters
of intent may be mailed to P.O. Box 12097, Austin, Texas 78711, or sent by
facsimile machine: (512) 475-2563. Applicants are encouraged to contact the
TCC immediately upon sending a letter of intent to ensure that the letter
is received. Contact TCC at (512) 463-3190.
Letter of intent requirements:
Letters of intent should identify the lead contractor and concisely describe
previous grant writing experience and success in the area of health care;
familiarity with private, local, state, and federal agency grant writing rules
and regulations; experience in conducting training or workshops in grant writing;
and planning and project management experience. A project plan and proposed
budget to provide the service is also required. Letters of intent, project
plan and proposed budget should not exceed five (5) pages total and must be
submitted in a font-size no smaller than 11 point.
Semi-finalist selection and application preparation
workshop:
TCC staff will review all letters of intent and select semi-finalists based
on the criteria outlined in this funding announcement. By August 27, semi-finalists
will be notified by telephone of their selection as a semi-finalist, mailed
a funding application packet, and invited to an orientation workshop to be
held in Austin on September 10, 2001. The workshop will be open to all semi-finalists
and will be conducted to clarify RFA requirements, provide an overview of
TCC responsibilities and clarify Council expectations. Semi-finalists are
responsible for any travel expenses (parking, transportation, lodging, etc.)
incurred to attend the workshop.
Application requirements:
Applications from the semi-finalists are due at the TCC office by 5 p.m.
on October 1, 2001. Applications must be submitted according to the TCC's
application instructions and forms.

Applicant qualifications:
The applicant should demonstrate:
* 6-7 years of progressive program experience with a history of accomplishing
successful funding proposals including budget development;
* Significant organizational skills, the ability to work well under pressure,
strong computer skills and excellent written, oral and interpersonal skills;
and
* Evidence of the ability to work collaboratively with partners to secure
grant funding.
Success in securing health related grants for underserved populations is
preferred.
Project requirements:
The project funded under this initiative must develop a plan and begin
implementing a grant program for the Texas Cancer Council, its projects and
potential projects. This program will create an innovative, effective process
to identify and acquire potential cancer prevention and control funding sources
(public and private). Other elements include the design of a resource list
of potential funding sources and a system to monitor progress. Implementation
phase may include developing cancer grant applications, designing and conducting
grantsmanship training and workshops, and providing ongoing technical assistance
to TCC projects and potential projects. Project staff will interface with
private, state and federal organizations to coordinate grant funding activities,
and will prepare a formal report that describes an effective plan and program
for the Council to follow which results in additional funding for Council
projects. The report is due to the Council on June 1, 2002. The applicant
will interact frequently and regularly with TCC staff and project staff. This
interaction may include visits to Council headquarters in Austin 4-6 times
per year.
Funding awards:
TCC staff will review applications for completeness and technical merit.
The Council will make final funding decisions on or about November 9, 2001.
Written notification of approval will be sent on or about November 16, 2001.
All applicants will receive written notification of the Council's decisions
regarding their applications.
The Council's funding decision will be based on:
* Applicant's qualifications to successfully accomplish the project;
* Reasonableness of budgeted amounts and appropriateness of budget justifications;
* Evidence of a sound and effective plan for accomplishing the project;
and
* Completeness and clarity of the application.
All TCC projects are funded via a cost reimbursement basis. Reimbursement
may be submitted monthly or quarterly, as preferred by the project.
It is anticipated that one project will be selected under this initiative
to receive Council funding. TCC funding is based on the merit of the application
received and the availability of funding.
All TCC funded projects must submit annual continuation applications. The
Council will award annual continuation contracts based upon a review of the
contractor's achievement of the prior year's work plan objectives and performance
measure projections, the merits of the contractor's continuation application,
and the availability of Council funding. Future year funding for this project
is projected to be up to $67,000 per year.
The TCC has sole discretion and reserves the right to reject any or all
applications received in response to this funding announcement. This announcement
does not constitute a commitment by TCC to award a contract or to pay costs
incurred in the preparation of an application.
Use of funds:
TCC funds are intended for start-up expenses and operational costs, such
as staff salaries and basic benefits, education materials, and other administrative
expenses. Funds may not be used for indirect costs, remodeling of buildings
or reduction of deficits from pre-existing operations. Further, funds may
not be used to supplant existing funds or services, or to duplicate existing
resources or services.

Notice and Opportunity to Comment on Requests for Consistency Agreement/Concurrence Under the Texas Coastal Management Program
On January 10, 1997, the State of Texas received federal approval of the
Coastal Management Program (CMP) (62 Federal Register pp. 1439-1440). Under
federal law, federal agency activities and actions affecting the Texas coastal
zone must be consistent with the CMP goals and policies identified in 31 TAC
Chapter 501. As required by federal law, the public is given an opportunity
to comment on the consistency of proposed activities in the coastal zone undertaken
or authorized by federal agencies. Pursuant to 31 TAC §§506.25,
506.32, and 506.41, the public comment period for these activities extends
30 days from the date published on the Coastal Coordination Council web site.
Requests for federal consistency review were received for the following projects(s)
during the period of June 8, 2001 through June 14, 2001. The public comment
period for these projects will close at 5:00 p.m. on July 20, 2001.
FEDERAL AGENCY ACTIONS:
Applicant: Central Power & Light; Location: The project site is located
at the Corpus Christi Ship Channel's Industrial Canal at Corps of Engineers
Station 1197+13, and will span from the Central Power and Light Company Nueces
Bay Power Station on the north side of the ship channel, and thence across
the ship channel to a co-generation facility at the CITGO Refinery, Corpus
Christi, Nueces County, Texas. The project can be located on the U.S.G.S.
quadrangle map entitled Corpus Christi, Texas. Approximate UTM Coordinates:
Zone 14; Easting: 656500; Northing: 3077500. CCC Project Number: 01-0210-F1;
Description of Proposed Action: The applicant proposes to directionally drill
a 138 kV electric transmission line below the Corpus Christi Ship Channel
(CCSC) to connect the electrical power co-generation facility at the CITGO
Refinery to the CPL Nueces Bay Power Station. The bore would run diagonally
across the CCSC. The bore hole size would be approximately 36 inches in diameter
and the electric transmission line conduit bundle would be approximately 30
inches in diameter. The total length of the bore would be approximately 2300
linear feet. The top of the transmission line would be at elevation -75 feet
Mean Low Tide or lower as it crosses below the CCSC. All surface work is to
take place on uplands. No discharge or fill material would result from this
project. Type of Application: U.S.A.C.E. permit application #22378 under §10
of the Rivers and Harbors Act of 1899 (33 U.S.C.A. 403).
Applicant: Village of Surfside Beach; Location: The project site is located
at Surfside Beach, Brazoria County, Texas, U.S.G.S. quadrangle map entitled
Freeport, Texas. Approximate UTM Coordinates: Zone 15; Easting: 277000, Northing:
3203900. CCC Project Number: 01-0214-F1 Description of Proposed Action: The
applicant proposes to place additional sand on their pedestrian beach, located
at Surfside Beach. The original permit authorized the applicant to place 44,000
cubic yards of sand on the beach above mean high tide. This proposed amendment
would authorize the placement of an additional 74,000 cubic yards of sand
along the same stretch of beach. A portion of this new sand would be placed
1-foot shoreward of the original beach nourishment project, below the mean
high tide line. Type of Application: U.S.A.C.E. permit application #21345(01)
under §10 of the Rivers and Harbors Act of 1899 (33 U.S.C.A. 403) and §404
of the Clean Water Act (33 U.S.C.A. §§125-1387).
Applicant: Donald Bagby; Location: The project site is located at 218 Dead
Ends Drive on the south shore of Copano Bay, Rockport, Arnasas County, Texas.
The project can be located on the U.S.G.S. quadrangle map entitled Rockport,
Texas. Approximate UTM Coordinates: Zone 14; Easting: 688500, Northing: 3107500.
CCC Project Number: 01-0218-F1; Description of Proposed Action: A coordination
letter was previously issued for a proposal to construct a 8-foot by 10-foot
walkway section and a 10.5-foot by 8-foot high (above pier deck) boatlift
as an addition to an existing residential pier. The applicant has revised
the request and now proposes to extend the existing 300-foot pier by 170 feet
with a 10-foot by 30-foot T-head. A 16-foot by 25-foot boatlift is also proposed.
Type of Application: U.S.A.C.E. permit application #19914(01) under §10
of the Rivers and Harbors Act of 1899 (33 U.S.C.A. 403).
FEDERAL AGENCY ACTIVITIES:
Applicant: U.S. Army Corps of Engineers, Galveston District; CCC Project
Number: 01-0212-F2; Description of Proposed Activity: The applicant proposes
to extend the expiration date of Department of the Army General Permit #17446(01)
from December 31, 2000 to December 31, 2006. The General Permit authorizes
the construction of spur jetties to control erosion for bank stabilization
activities.
Pursuant to §306(d)(14) of the Coastal Zone Management Act of 1972
(16 U.S.C.A. §§1451-1464), as amended, interested parties are invited
to submit comments on whether a proposed action is or is not consistent with
the Texas Coastal Management Program goals and policies and whether the action
should be referred to the Coastal Coordination Council for review.

Request for Information: Pursuant to §403.028, Texas Government Code,
the Comptroller of Public Accounts (Comptroller) issues this Request for Information
(RFI) from qualified, independent individuals, firms, and institutions to
provide information specified below to assist Comptroller in developing a
methodology to measure the incidence of potential fraud and abuse in the Texas
Medicaid Program (Program) contracts with Health Maintenance Organizations
(HMOs). Comptroller plans to conduct a pilot study to measure the incidence
of fraud and abuse in the State of Texas Access Reform (STAR) Medicaid managed
care program and a methodology must be developed to measure fraud and abuse.
The portion of the managed care delivery model that would be subject to the
pilot study is the HMO contracts. Comptroller has published two studies measuring
the incidence of potential fraud and abuse in the Medicaid acute care fee-for-service
program. The most recent report, entitled Texas Health Care Claims Study,
is available at http://www.window.state.tx.us. Qualified, interested respondents
must review and respond to this RFI no later than 2:00 p.m., Central Zone
Time (CZT), Tuesday, July 31, 2001.

Eligible Applicants. The Texas Education Agency (TEA) is requesting applications
under Request for Applications (RFA) #701-01-028 from school districts, shared
services arrangements of school districts, and/or open-enrollment charter
schools to continue programs implemented during the 2000- 2001 school year
in either Cycle 3 or Cycle 4. Also, applications are requested from school
districts, shared services arrangements of school districts, and/or open-enrollment
charter schools that did not have Cycle 3 or Cycle 4 grants to expand their
existing half-day prekindergarten programs to full- day programs.
Description. Cycle 5 of the grant program will be used to provide continuing
operating funds for programs that were implemented in the 2000-2001 school
year and funds permitting, for the expansion of existing half-day prekindergarten
programs to full-day programs for those school districts and open-enrollment
charter schools that did not have programs during the 2000-2001 school year.
Dates of Project. The Prekindergarten and Kindergarten Grant Program (Cycle
5, Prekindergarten Expansion Grants) will be implemented during the 2001-2002
school year. Cycle 5 expansion grants may be renewed for the 2002-2003 school
year, provided all terms and conditions of 2001-2002 funding awards have been
met.
Project Amount. The 77th Texas Legislature, 2001, appropriated $100 million
per year to the Prekindergarten and Kindergarten Grant Program for the 2001-2002
and 2002-2003 school years, representing a total of $200 million in state
funds. Cycle 5 grants will be funded based on the additional attendance in
the same manner as current Foundation School Program funding.
Selection Criteria. Applications must address each requirement as specified
in the RFA to be considered for funding. Priority will be given to school
districts and open-enrollment charter schools that received awards under previous
Cycle 3 or Cycle 4 funding. If funds remain after funding this priority group,
new expansion programs will be funded. Within the group of new expansion program
applicants, priority will be given to school districts and open-enrollment
charter schools where student performance on the Grade 3 Texas Assessment
of Academic Skills (TAAS) tests falls substantially below the state average.
Additional priority will be given to school districts and open-enrollment
charter schools that serve the highest percentages of eligible (limited English
proficient, educationally disadvantaged, and homeless) children. Educationally
disadvantaged is defined as those children eligible to participate in the
national free or reduced-price lunch program.
The TEA is not obligated to approve an application, provide funds, or endorse
any application submitted in response to this RFA. This RFA does not commit
TEA to pay any costs before an application is approved. The issuance of this
RFA does not obligate TEA to award a grant or pay any costs incurred in preparing
a response.

RESIDENTIAL MORTGAGE REVENUE AND REFUNDING BONDS
Notice is hereby given of a public hearing to be held by the Texas Department
of Housing and Community Affairs (the "Department") at 507 Sabine Street,
Room 437, Austin, Texas, at 12:00 noon on July 27, 2001, with respect to an
issue of tax-exempt residential mortgage revenue bonds (the "Bonds") to be
issued in an aggregate face amount of not more than $161,000,000.
A portion of the proceeds of the Bonds will be used to finance an estimated
$120,000,000 single family residential mortgage loans made to eligible very
low, low and moderate income first-time home buyers for the purchase of homes
located within the State of Texas. A portion of the proceeds of the Bonds
may be used to refund a portion of the outstanding Texas Housing Agency (predecessor
to the Department) Residential Mortgage Revenue Bonds, Series 1988A and Series
1989A. A portion of the proceeds of the Tax-Exempt Bonds will be used to refund
all or a portion of the Department's outstanding Single Family Mortgage Revenue
Refunding Tax-Exempt Commercial Paper Notes, Series A, thereby making funds
available to make additional mortgage loans.
For purposes of the Department's mortgage loan finance programs, eligible
borrowers generally will include individuals and families whose family income
does not exceed, (i) for families of three or more persons, 115% (140% in
certain targeted areas) of the area median income, and (ii) for individuals
and families of two persons, 100% (120% in certain targeted areas) of the
area median income. The Department anticipates setting aside approximately
30% of the funds made available for borrowers of very low income (60% of area
median income) for approximately one year. In addition, substantially all
of the borrowers under the programs will be required to be persons who have
not owned a principal residence during the preceding three years. Further,
residences financed with loans under the programs will be subject to certain
other limitations, including limits on the purchase prices of the residences
being acquired. All the limitations described in this paragraph are subject
to revision and adjustment from time to time by the Department pursuant to
applicable federal law and Department policy.

their views with respect to the Department's mortgage loan finance program

The Commissioner of Insurance will hold a public hearing under Docket No.
2487, at 9:30 a.m., June 26, 2001 at the LBJ Library Auditorium, 2313 Red
River, Austin, Texas to consider public testimony from insurers, consumers,
mortgage lenders, and any other interested parties on the current coverage
provided in the Texas residential property policies for mold or other fungi
losses. This is an information-gathering hearing which is being held for the
purpose of soliciting input on the coverage for mold or other fungi that is
currently contained in the Texas residential property policy forms. This hearing
is intended to provide all interested parties with the opportunity to comment
on the extent to which such coverage should be provided. All interested parties,
including members of the general public, are invited to attend and provide
comments and recommendations.
Currently, the Texas Homeowners Policies (HO-B, HO-C, HO-CT, and HO-CON-C)
and the Texas Dwelling Policy (TDP-3) would exclude losses caused by rot,
mold, or other fungi as well as losses caused by dampness of atmosphere, extremes
of temperature, or contamination. However, these policies and forms HO-BT,
HO-CON-B, and TDP-2 include coverage for a loss caused by mold or other fungi
provided the loss (for example, water damage) causing the ensuing mold or
fungi is a covered cause of loss under the policy. Article 5.35 of the Insurance
Code allows for the approval of endorsements to be used with residential property
policy forms. An insurer has filed with the Department proposed endorsements
that exclude all coverage for mold or other fungi from the Texas residential
property policy forms. The Commissioner has not yet acted on this filing.
This specific filing is not being considered in this hearing, but the information
obtained during the course of this hearing may be considered by the Commissioner
in his action on this filing.
This hearing is held pursuant to the Insurance Code Chapter 31 and Article
5.35. Chapter 31 contains the general authority of the Commissioner. Article
5.35 authorizes the Commissioner to adopt or approve policy forms and endorsements
for residential property insurance in Texas.
Anyone wishing to speak at this hearing will be required to complete a

The Texas Health Reinsurance System was created by the Legislature in 1993
and began engaging in the reinsurance of small employer group health insurance
plans in 1995. The Commissioner of Insurance is an ex-officio member of the
Board of Directors of the System. Insurance Code, Article 26.55, requires
the Board of Directors to adopt a plan of operation. The Plan of Operation
becomes effective on the written approval of the Commissioner. The Commissioner
approved the Plan of Operation on September 6, 1995.
The Board of Directors of the System recommended the following amendment
to the Plan of Operation. This is the first amendment to the Plan of Operation
recommend by the Board of Directors of the System The amendment provides guidance
to the Administrator of the System in auditing reinsured carriers for the
calculation of reinsurance premiums and reinsured claims.
The amendment is proposed to be added to the Plan of Operation, Article
XI - Audit Functions.
External Audit Functions
A. Each reinsuring company member of the System shall hire a certified
public accountant (CPA) or other party approved by the board to conduct audits
of various items related to the System reinsurance and assessments. To be
acceptable, the auditor must be independent, in accordance with standards
established by the Audit Committee. The audits must be made in accordance
with generally accepted auditing standards as adopted by the membership of
the American Institute of Certified Public Accountants.
B. The audits shall be conducted in accordance with a uniform audit program
(hereinafter called "Audit") for system members, as developed by the Board.
This Audit shall clearly specify all items to be audited. It shall include
a certification statement form, to be completed by the Auditor, to verify
the completion of all prescribed audit procedures as dictated by the Audit.
Also, details regarding the number and types of records reviewed and any errors
found shall be submitted in a report which accompanies the certification statement.
A copy of this report and the certification statement shall be submitted to
the Board by the auditor.
C. The audit shall include, but not be limited to, detail testing of representative
samples of the following items.
1. Reinsurance claims submitted to the System, in particular:
a. Eligibility of claimants and their small employers for reinsurance by
the System;
b. Proper determination of reinsurance claim amount by the member.
2. Reinsurance premiums submitted to the system, including:
a. Eligibility of those lives for whom premium is paid for reinsurance
by the System;
b. Proper determination of reinsurance premium amounts paid.
3. Data submitted to the System for use in the calculation of member assessments
for net losses.
D. A minimum of three (3), but no more than five (5) members will be audited
each year. The members shall be selected on the basis of the amount of premium
volume in the Texas small employer marketplace. If necessary, the auditors
shall select the other members(s) for the audit. The cost of the audit of
a member shall be borne by that member.
E. Random audits of provider bills or other records shall be conducted
as deemed necessary by the Audit Committee to verify the accuracy and appropriateness
of reinsurance claim submissions.
F. The Board shall have the right to conduct such additional audits of
members as it deems appropriate.
G. All information disclosed in the course of the audit of a member company
shall be considered privileged information by the member company, the auditing
firm and the System.
H. The System shall have an annual audit of its operations conducted by
an independent certified public accountant, as approved by the Board. The
Board shall file this annual audit with the Commissioner for his review. This
audit shall encompass at least the following items:
1. The handling and accounting of assets and money for the System;
2. The annual fiscal report of the System;
3. The calculation of the premium rates charged for reinsurance by the
System;
4. The calculation and the collection of any assessments of members for
net losses; and
5. The reinsurance premiums due to the system and the claim reimbursements
made to the members.

BACKGROUND
PRPC is responsible for administering approximately $12,000,000 in Workforce
Development funds provided to the 26 counties of the Texas Panhandle. PRPC's
responsibilities include oversight for federal and state-supported Child Care,
CHOICES, Food Stamp Employment and Training, Job Training Partnership Act-National
Reserve Account, Wagner-Peyser Employment Service, Welfare-to-Work and Workforce
Investment Act programs. These resources provide employment, training and
related services to the public, primarily through the region's seven workforce
centers. PRPC subcontracts the delivery of all program services, excluding
Child Care, to Green Thumb, Inc., a national non-profit organization whose
fiscal operations and records are located in Waco, Texas. The delivery of
Child Care program services is contracted to Children's Learning Centers of
Amarillo, Inc.
PERFORMANCE
PRPC proposes to contract with an appropriate vendor to plan and conduct
comprehensive fiscal and program monitoring as required by its funding agency,
the Texas Workforce Commission. Areas to be monitored will include, but not
necessarily be limited to:
* Financial accountability, internal controls, payroll and cash management
* Procurement and contracting
* Property management
* Management systems, reporting and recordkeeping
* Cost classification, allowability and limitations
* Subcontractor compliance and performance
* Program-specific participant eligibility
* Employment, training and support activities
* Personnel standards and practices
* Fraud and abuse
* Grievances, hearings and investigations
* Others as appropriate
Duties of the selected contractor will include, but not necessarily be
limited to:
* Development of a schedule and plan for comprehensive monitoring of all
program activities and subcontracts
* Development of appropriate monitoring instruments
* Conducting monitoring through both on-site and desk reviews
* Preparation of monitoring reports, including findings and recommendations
for improvement
* Conducting follow-up to ensure that identified problems have been addressed
* Maintenance and submission to PRPC of all reports, responses and supportive
documentation
* Assisting PRPC staff with annual risk assessment.
PERIOD
Monitoring activities must be completed by September 30, 2001. The contract

Request for Information
The Texas A&M University System (System) requests information from
law firms interested in representing the System and its component institutions
in bond matters. This RFI is issued for the purpose of establishing (for the
biennium beginning September 1, 2001) a referral list from which the System,
by and through its Office of General Counsel, will select appropriate counsel
for representation on specific bond matters and securities law issues as the
need arises. These needs include the usual and necessary services of a bond
counsel in connection with issuance, sale and delivery of bonds and notes.
Description.
The System comprises nine universities,
eight state agencies and a health science center in Texas. Public, bond issuance
is conducted under two major programs and is rated by at least two major rating
agencies. Bonds are issued under authority granted the System in Article VIII, §18
of the Texas Constitution (Permanent University Fund). A flexible rate note
program with an authorized limit of $80 million is frequently used to finance
capital improvement needs of the program. Note sales are normally conducted
once or twice each year. Currently, $35.6 million is issued and outstanding.
Advance refunding of Permanent University Fund bonds is conducted periodically
based on potential savings opportunities. Under authority granted in Chapter
55, Texas Education Code and Texas Civil Statutes, Articles 717k and 717q,
and other applicable laws, the System issues revenue bonds for capital improvements.
The System employs a revenue bond program, which offers a combined pledge
of all legally available revenues with certain exceptions (the Revenue Financing
System). A commercial paper program is used for interim financing with long
term fixed rate bonds sold to provide more permanent financing. The commercial
paper program is presently authorized up to $125 million. The entire amount
of outstanding commercial paper ($45 million) is being refunded by bonds scheduled
to close on June 14, 2001. Advance refunding of bonds and escrow restructures
of previously defeased bonds, based on market opportunities, may be expected.
Federal tax related matters regarding bonds issued by the System, including
strategies and management practices in the conduct of a debt program, requires
a close working relationship with bond counsel. Contact is frequent, particularly
in regard to the Revenue Financing System program due to the significant level
of capital improvements anticipated throughout the System over the next two
years. The System invites responses to this RFI from qualified firms for the
provision of such legal services under the direction and supervision of the
System's Office of General Counsel.
Responses.
Responses to this RFI should include
at least the following information:
(1) a description of the firm's or attorney's qualifications for performing
the legal services, including the firm's prior experience in bond issuance
matters and securities law issues;
(2) the names, experience, and technical expertise of the attorneys who
may be assigned to work on such matters;
(3) appropriate information regarding efforts made by the firm to encourage
and develop the participation of minorities and women in the provision both
of the firm's legal services generally and bond matters in particular;
(4) the submission of fee information (either in the form of hourly rates
for each attorney who may be assigned to perform services in relation to the
System's bond matters, flat fees, or other fee arrangements directly related
to the achievement of specific goals and cost controls) and billable expenses;
(5) disclosures of conflicts of interest (identifying each and every matter
in which the firm has, within the past calendar year, represented any entity
or individual with an interest adverse to the System or to the State of Texas,
or any of its boards, agencies, commissions, universities; or elected or appointed
officials); and
(6) confirmation of willingness to comply with policies, directives and
guidelines of the System and the Attorney General of the State of Texas.

professional services as in the following description:
Conduct an Economic Impact Study related to General Aviation in Texas.
This study will evaluate the economic impact of all publicly owned or operated
basic utility, general utility, transport, and reliever airports within the
Texas Airport System Plan.
The Proposal shall include:
1. Firm name, address, phone number, and name of person to contact regarding
the proposal.
2. Proposed project management structure delineating key personnel and
subconsultants (if any).
3. Qualifications and recent, relevant experience (past five years) of
the firm, key personnel and subconsultants relative to the performance of
recent, relevant similar services for aviation economic impact studies.
4. Proposed project schedule, including major tasks and target completion
dates.
5. Technical approach - a detailed discussion of the tasks or steps to
accomplish the project.
6. List of references including the name, address, and phone number of
the person most closely associated with the firm's prior performance of similar
projects.
7. Statement regarding an Affirmative Action Program.
8. Proposed Disadvantaged Business Enterprise (DBE) participation.
The study will include, though not be limited to, the following:
1. Identify existing airport activity levels and provide forecasts of future
activity levels.
2. Identify and quantify the total economic impact of these airports both
individually and as a whole.
3. Provide professional services for inventory phase, forecast phase, analysis
phase, and deliverable phase.
4. Participate as state's professional representative for the project,
providing professional consultation and advise incidental thereto.
5. Attend conferences and meetings with the state and other interested
parties as needed to review available data and to clarify and define the requirements
of the project.
Proposal Submission:
Those interested consultants should submit six copies of brief proposals
consisting of the minimum number of pages sufficient to provide the above
information for the project. Proposals must be postmarked by U. S. Mail by
midnight July 25, 2001. Mailing address: TxDOT, Aviation Division, 125 E.
11th Street, Austin, Texas 78701-2483. Overnight delivery must be received
by 4:00 p.m. on July 25, 2001; overnight address: TxDOT, Aviation Division,
200 E. Riverside Drive, Austin, Texas, 78704. Hand delivery must be received
by 4:00 p.m. July 27, 2001; hand delivery address: 150 E. Riverside Drive,
5th Floor, South Tower, Austin, Texas 78704.
The duly appointed consultant selection committee will review all proposals
and select three to five firms for interviews. The final consultant selection
by the committee will be made following the completion of the review of proposals
and interviews.
TxDOT reserves the right to reject any or all proposals, and to reopen
the consultant selection process.
