Chapter 50. LEGISLATIVE SALARIES AND PER DIEM

The Texas Ethics Commission adopts an amendment to §50.1, concerning legislative per diem. The amendment is adopted without changes to the proposed text as published in the December 8, 2000, issue of the Texas Register (25 TexReg 12029) and will not be republished. The amendment was made to reflect the increase in the per diem rate allowed for federal income tax purposes since the last legislative session.

No comments were received regarding the amendment.

This amendment is adopted under the Texas Constitution, Article III, §24a, which provides that the commission shall set the per diem of members of the legislature and the lieutenant governor, and the Government Code, Chapter 571, §571.062, which authorizes the Texas Ethics Commission to adopt rules to implement laws administered and enforced by the commission.

The amended section affects the Texas Constitution, Article III, §24, Article III, §24a, and Article IV, §17.

This agency hereby certifies that the adoption has been reviewed by legal counsel and found to be a valid exercise of the agency's legal authority.
