The Texas Department of Public Safety adopts the repeal of §1.38, concerning Personnel Complaint Policy, without changes as published in the January 7, 2000, issue of the Texas Register (25 TexReg 57).

The justification for the repeal will allow for the adoption of new §1.38 that will better inform the public of the department's personnel complaint policies.

No comments were received regarding adoption of the repeal.

The repeal is adopted pursuant to Texas Government Code, §411.006(4), which provides the director with the authority to adopt rules, subject to commission approval, considered necessary for the control of the department.

This agency hereby certifies that the adoption has been reviewed by legal counsel and found to be a valid exercise of the agency's legal authority.

The Texas Department of Public Safety adopts new §1.38, concerning Personnel Complaint Policy, without changes to the proposed text as published in the January 7, 2000, issue of the Texas Register (25 TexReg 57) and will not be republished.

The justification for the new section will be clarification to the public regarding department policy on how to initiate personnel complaints. The new section describes the department's current procedures by which complaints are filed and resolved by the department and methods by which consumers and service recipients are notified of the name, mailing address, and telephone number of the department for the purpose of directing complaints to the department.

No comments were received regarding adoption of the new section.

The new section is adopted pursuant to Texas Government Code, §411.0195 which states the director, by rule, shall establish methods by which consumers and service recipients are notified of the name, mailing address, and telephone number of the department for the purpose of directing complaints to the department.

This agency hereby certifies that the adoption has been reviewed by legal counsel and found to be a valid exercise of the agency's legal authority.
