37 TAC §145.71

The Policy Board of the Texas Board of Pardons and Paroles adopts an amendment to 37 TAC §145.71, concerning the procedures that are to be followed when a releasee requests reinstatement following revocation of parole or mandatory supervision, without changes to the proposed text as published in the January 21, 2000, issue of the Texas Register (25 TexReg 357).

The adoption of amended §145.71 will clarify procedures that are to be followed when requesting a reinstatement of parole.

No comments were received regarding adoption of the amendment as proposed.

The amendment is adopted under Article 42.18, §6A(c)(1), Code of Criminal Procedure, Article, recodified effective September 1, 1999, as §508.036(c)(1), Government Code; and under Article 42.18, §8(g), recodified effective September 1, 1999, as §508.044(d), Government Code. Both of these statutes provide specific rulemaking authority for the Policy Board of the Board of Pardons and Paroles.

This agency hereby certifies that the adoption has been reviewed by legal counsel and found to be a valid exercise of the agency's legal authority.
