The Texas Credit Union Commission adopts new §97.200 pertaining to reimbursement of employee training and education expenses without change to the language published in the November 5, 1999 issue of the Texas Register (24 TexReg 9732). The new rule provides specific authorization for employee training and education supported by the agency as required by §656.048 and §656.103 of the Texas Government Code. The rule sets forth the type of training that the Department will provide to its employees, as well as establishes a tuition reimbursement program. It also makes availability of training and educational opportunities contingent upon available funding.

No public comments were received.

The new section is adopted under the provisions of Texas Government Code §656.048, which require state agencies to adopt rules relating to the eligibility of the agency's administrators and employees for training and education supported by the agency, and to the obligations assumed by the administrators and employees on receiving the training and education. The Commission interprets this section as authorizing it to adopt rules setting forth the conditions under which the Credit Union Department shall pay certain training and education related expenses on behalf of its employees.

The specific section affected by the adopted rule is Texas Finance Code §15.402 pertaining to the general authority of the Commission.

This agency hereby certifies that the adoption has been reviewed by legal counsel and found to be a valid exercise of the agency's legal authority.
