rule, associations must pay live racing fees and simulcast fees no later than
10:00 a.m. on the day following either the live race day or day on which the
simulcast is offered. The amendment changes the deadline for submitting these
fees from 10:00 a.m. to 5:00 p.m. on that same day. This change is a result
of requests from the associations.
No comments were received regarding the adoption of this amendment.
The amendment is adopted under the Texas Civil Statutes, Article
179e, §3.02, which authorizes the Commission to adopt rules for conducting
racing with wagering and for administering the Texas Racing Act; §3.07,
which authorizes the commission to impose a fee to offset the costs of compensating
officials and to set the amount of the compensation by rule; §6.18, which
authorizes the Commission to prescribe reasonable annual fees to be paid by
racetrack licensees and §11.011 which authorizes the Commission to adopt
rules to regulate simulcasting.
The amendment implements Texas Civil Statutes, Article 179e.
This agency hereby certifies that the adoption has been reviewed
by legal counsel and found to be a valid exercise of the agency's legal authority.
