The State Board of Barber Examiners files this notice of intention to review §§51.51-51.86, concerning Examination and Licensing, pursuant to the General Appropriations Act, Article IX, Section 167, 75th Legislature.

As part of this review process, the board is proposing amendments to §51.51 of this title (relating to Payment of Fees), §51.52 of this title (relating to Name Change), §51.55 of this title (relating to Number of Examination Questions), §51.57 of this title (relating to Applying for Examination), §51.58 of this title (relating to Deadline for Examination Application), §51.60 of this title (relating to Items to Bring to Examination), §51.61 of this title (relating to Failure to Appear at Examination, §51.62 of this title (relating to Notification of Examination Results), §51.63 of this title (relating to Failure of Examination), §51.64 of this title (relating to Deadline for licensing Application), §51.80 of this title (relating to Transfer of Student Hours from Out of State), and §51.84 of this title (relating to Reciprocal Licensing Policy). The proposed amendments may be found in the Proposed Rules section of the Texas Register. As required by Section 167, the board will accept comments regarding whether the reasons for adopting the rules continue to exist together with any substantive comments submitted concerning the proposed amendments.

The board is also proposing the repeal of §51.65 of this title (relating to Student Barber's Application for Examination), §51.66 of this title (relating to Student Teacher's Application for Examination), §51.67 of this title (relating to Former Licensee's Application for Examination), §51.68 of this title (relating to Out-of-State Application for Examination), §51.69 of this title (relating to Physician's (Health) Certificate Form), §51.70 of this title (relating to Registered Barber Certificate), §51.71 of this title (relating to Teacher's Certificate), §51.72 of this title (relating to Barber's Technician Certificate), §51.73 of this title (relating to Manicurist's Certificate), §51.74 of this title (relating to Journeyman Barber Permit), §51.75 of this title (relating to Booth Rental Permit), §51.76 of this title (relating to Certificate of Licensed Barber College), §51.77 of this title (relating to Application for Temporary Barber Shop Permit), §51.78 of this title (relating to Barber Shop Floor Plan), §51.79 of this title (relating to Barber Shop Permit), §51.81 of this title (relating to Expiration Dates of Certificates and Proration of Fees), and §51.86 of this title (relating to Processing Time for Licenses and Permits; Appeals). The proposed repeals may be found in the Proposed Rules section of the Texas Register. As required by Section 167, the board will accept comments regarding whether the reasons for adopting the rules continue to exist together with any substantive comments submitted concerning the proposed repeals.

Finally, the board is proposing to readopt §51.54 of this title (relating to Foreign Language Examinations), §51.83 of this title (relating to Licensing of Felons), and §51.85 of this title (relating to Reciprocal/Endorsement Licensing of Barbers). The agency's reasons for adopting these rules continue to exist in order to discharge the agency's statutory examination and licensing responsibilities in order to discharge the agency's statutory examination and licensing responsibilities.

The Department of Information Resources (DIR) files this notice of intention to review and consider for readoption, revision, or repeal, Title 1, Texas Administrative Code, Chapter 201, Section 201.16, "Minimum Standards for Meetings Held by Videoconference Call." This review and consideration is being conducted in accordance with the General Appropriations Act, House Bill 1, 75th Legislature, Article IX, §167. The review will include, at a minimum, an assessment by DIR as to whether the reasons for adopting or readopting these rules continue to exist.

Notice of Intention to Review Chapters 156 and 164.

The Texas Workers' Compensation Commission files this notice of intention to review the rules contained in Chapter 156, concerning Representative of Parties and in Chapter 164, concerning Extra-Hazardous Employer Program. This review is pursuant to the General Appropriations Act, Article IX, §167, 75th Legislature (1997).

The agency's reason for adopting the rules contained in these chapters continues to exist and it proposes to readopt these rules.

Adopted Rule Review

General Services Commission

Title 1, Part V

The General Services Commission (the "Commission") has completed the review of Title 1, Texas Administrative Code, Part V, Chapter 125, Subchapter B, Sections 125.41 thru 125.49 concerning State Vehicle Fleet Management, and Subchapter C, Sections 125.63 thru 125.69 concerning the Texas Alternative Fuels Program as noticed in the March 19, 1999, issue of the Texas Register (24 TexReg 2031). The Commission readopts Chapter 125, Subchapter B and Subchapter C pursuant to the Appropriations Act of 1997, H.B. 1, Article IX, Section 167 (Section 167), and finds that the reason for adopting Subchapters B and C of Chapter 125 continues to exist.

The Commission received no comments on the Section 167 requirements as to whether the reasons for adopting the rules continue to exist. As part of this review process, the Commission proposed amendments to Subchapter B, Sections 125.41 thru 125.49, and Subchapter C, Sections 125.63 thru 125.69. The amendments were published in the March 19, 1999, issue of the Texas Register (24 TexReg 1883). The Commission received no comments on the proposed amendments. The adoption of the amendments may be found in the Adopted Section of this Texas Register .
