The Texas Department of Public Safety adopts new §1.131, concerning Fees For Copies of Records, without changes to the proposed text as published in the January 29, 1999, issue of the Texas Register (24 TexReg 505) and will not be republished.

The justification for this new section will be to ensure that costs for processing and searching of nonstandard records will be assessed to those utilizing the service and not be imposed to the tax-paying public.

No comments were received regarding the adoption of this new section.

The new section is adopted pursuant to Texas Government Code, §411.006(4), which provides the director with the authority to adopt rules, subject to commission approval, considered necessary for the control of the department.

This agency hereby certifies that the adoption has been reviewed by legal counsel and found to be a valid exercise of the agency's legal authority.

Chapter 95. Youth Discipline

Subchapter A. Disciplinary Practices

The Texas Youth Commission (TYC) adopts an amendment to §95.9, concerning parole revocation consequence, without changes to the proposed text as published in the January 29, 1999, issue of the Texas Register (24 TexReg 506).

The justification for amending the section is to provide increased protection for the public by allowing parole revocation of violators of CINS probation who meet revocation criteria.

The amendment will provide that youth classified as Violators of Conduct Indicating a Need for Supervision (CINS) Probation will be subject to the same parole revocation criteria as youth classified as general offenders.

No comments were received regarding adoption of the amendment.

The amendment is adopted under the Human Resources Code, §61.075, concerning determination of treatment, which provides the Texas Youth Commission with the authority to order the youth's confinement under conditions it believes best designed for the child's welfare and the interests of the public.

The adopted rule implements the Human Resource Code, §61.034.
