Notice and Opportunity to Comment on Requests for Consistency Agreement/Concurrence under the Texas Coastal Management Program

On January 10, 1997, the State of Texas received federal approval of the Coastal Management Program (CMP) (62 Federal Register pp. 1439-1440). Under federal law, federal agency activities and actions affecting the Texas coastal zone must be consistent with the CMP goals and policies identified in 31 TAC §501. Requests for federal consistency review were received for the following projects(s) during the period of January 13, 1999, through January 20, 1999:

FEDERAL AGENCY ACTIONS:

Applicant: CBH Services, Inc.; Location: The project site is located along the Sabine-Neches Canal, adjacent to the East Turning Basin and approximately 1.4 miles southwest of the State Highway 82 bridge over the Sabine-Neches Canal, in Port Arthur, Jefferson County, Texas; Project Number: 99-016-F1; Description of Proposed Action: The applicant proposes to create a deepwater slip for marine industrial repairs. An area, within an existing slip, measuring 300 feet by 800 feet would be mechanically dredged to a depth of 23 feet below mean low water. Approximately 38,000 cubic yards of material would be dredged from the area and placed in a 5-acre upland placement area within the applicant's property. Approximately 2,900 linear feet of steel sheet pile bulkhead would be placed along the existing slip to protect the shoreline from erosion. The bulkhead and associated backfill would be placed above mean high tide; Type of Application: U.S.A.C.E. permit application #21541 under §10 of the Rivers and Harbors Act of 1899 (33 U.S.C.A. 403).

Texas Planning Council for Developmental Disabilities

Intent to Award Grant

The Texas Planning Council for Developmental Disabilities (TPCDD) announces its intention to award a grant to the Walsh Company to continue support for the activity "Partners in Policymaking."

Background: The Walsh Company submitted a proposal in response to a Request for Proposals (RFP) for Support for Training Activities reposted in the August 9, 1991, issue of the Texas Register (16 TexReg 4376). That Request for Proposal (RFP) invited proposals for a grant project that would provide support and assistance to the Council for coordination of the activity entitled "Partners on Policymaking." Pursuant to the aforementioned RFP, in August 1992, a replacement award was made to the Walsh Company due to an emergency. Subsequent awards were granted in July 1994 and July 1995. The Council voted to approve funding for an additional year at its August 1997 Quarterly Council Meeting. An intent to award was published in the May 8, 1998, issue of the Texas Register (23 TexReg 4686) and the award was made to the Walsh Company on June 3, 1998. At the August 7, 1998, Council meeting, five additional years of funding was approved. The TPCDD intends to award a grant to the Walsh Company to continue its support of the "Partners in Policymaking" training activity because of its experience and contributions towards the success of that project.

Description of Project: The project will provide support and assistance to the TPCDD for coordination of the activity entitled "Partners in Policymaking," a leadership training project for individuals with developmental disabilities and family members. The project will provide coordination for eight weekend training sessions yearly, an advanced leadership training institute during the summer of 1999, 2001 and 2003, and various other activities related to the ongoing support and coordination of the TPCDD Partners in Policymaking project. The TPCDD will maintain final authority for dates, content, and agendas of each event, and determination of topics and presenters. The grantee will provide staff resources to coordinate all training activities and presentations, as well as support activities, such as acquiring meeting space and facilities, coordinating application and registration processes, coordinating equipment needs, processing timely reimbursements to participants, facilities and presenters, arranging travel and transportation for presenters and participants, and timely reporting to the TPCDD.

Terms and Funding: Funding for this grant will begin June 1, 1999 and end August 31, 2004. Estimated funding will not exceed $485,000 annually during this period.

This announces the availability of funds to be awarded on behalf of the Texas Planning Council for Developmental Disabilities (TPCDD) by the Texas Rehabilitation Commission.

The purpose of this Request for Proposal (RFP) is to solicit proposals for one project which will demonstrate innovative and effective ways to work with local communities to organize training and technical assistance to promote leadership for individuals with disabilities and their family members.

The selected grantee will be responsible for sub-granting with communities statewide throughout the life of the grant. Community sites selected will be representative of the geographical diversity of the state including at least one from each of the following areas: urban, rural, small urban and Mexican border areas. A minimum of five communities is expected within the first two years of the grant, with additional communities added each successive year thereafter. A minimum of ten communities total is anticipated during the life of the grant. The Community Partners Project is an effort to create a mechanism to provide leadership skills and training to many more people with disabilities and their families than is currently available through the Partners in Policymaking Program.

Under this announcement, one project will be funded for up to five years. The grantee will be responsible for sub-granting with at least five local community sites representing at a minimum, a rural, Mexico border area, large and small urban communities during the first two years of the project, and with at least ten communities during the overall grant project. Funding for years two through five will be contingent upon an annual review of performance, availability of federal funding, and TPCDD funding priorities. The initial funding period is June 1, 1999 through May 31, 2000. Estimated funding to be determined but not to exceed $150,000 for the first year and $225,000 annually for each 12-month budget period of years two through five. Non-federal match of 25% is required for the first year. Project activities located in counties designated as federal poverty areas require a minimum of 10% matching resources. Increasing non-federal match will be required in years two through five. Federal funds received from other sources cannot be used to match federal funds received under this grant.

State Board for Educator Certification

Request for Proposals Concerning Services for Developing and Administering Assessments for Educator Certification

Filing Authority. This Request for Proposals (RFP) #705-99-01.001 is filed under the Texas Education Code, §21.041 and §21.048.

Eligible Proposers. The State Board for Educator Certification (SBEC) is requesting proposals from nonprofit organizations, institutions of higher education, private companies, individuals, regional education service centers, and other entities. Historically underutilized businesses (HUBs) and Texas vendors are encouraged to submit a proposal.

Description. This RFP provides for services relating to the development and administration of current and future educator tests that are required for certification. Prior to certification as an educator by the state, all candidates must pass appropriate certification tests by demonstrating the knowledge and skills necessary to perform effectively as educators. Over 70,000 Examinations for the Certification of Educators in Texas (ExCET) and Texas Oral Proficiency Tests (TOPT) have been given annually during the last few years at test administrations across Texas; these numbers are expected to continue in the future.

Activities under this RFP are divided into two components: (1) Component A is the continued administration of the current ExCET and TOPT tests beginning July 1, 1999; (2) Component B is the development and administration of 35 new ExCET and TOPT tests (development of selected tests shall begin immediately for their initial administration in July 2000). Other aspects of testing required in the RFP are the use of technology for test administration, enhanced accessibility for examinees, and the development and administration of practice tests and preparation materials.

Proposers may submit an offer to perform activities for (1) Component A only, (2) Component B only, or (3) both Component A and Component B.

Payments to Proposer for services conducted under this RFP will be paid entirely from fees collected from examinees; consequently, payment to Proposer for services shall be made at the discretion of the SBEC depending upon the availability of funds. As a result, total payment for costs for some services may not occur until a period of time after a development or administration activity begins or is completed.

Dates of Contract. The contract period will be March 12, 1999 (anticipated) through June 30, 2004; at the discretion of the SBEC, the contract may be extended for two additional one-year periods.

Selection Criteria. Proposer(s) will be selected based on the ability of the proposer to carry out all requirements contained in the RFP. The SBEC will base its selection on, among other things, demonstrated competence and qualifications of the proposer. The selection criteria and review process are specified in the RFP. The SBEC reserves the right to select from the highest ranking proposals the proposal that best addresses all requirements in the RFP.

Notice is hereby given that the Bureau of Radiation Control and the Bureau of Food and Drug Safety, Texas Department of Health (department), jointly issued a notice of violation and proposal to assess an administrative penalty against Ms. Sharon Holden and Ms. Linda Teresso, doing business as The Elysium Spa and Salon, Arlington, for violations of the Texas Regulations for Control of Laser Radiation Hazards and the Texas Food, Drug, and Cosmetic Act . A total penalty of $35,000 is proposed to be assessed against Ms. Holden and Ms. Teresso.

The violations are of significant concern to the department in that an unregistered laser at The Elysium Spa and Salon facility resulted in physical injury to a consumer. Additionally, the laser device was used without proper prescriptive authority or supervision. The use of unregistered laser devices with apparent disregard for the requirements associated with the use of prescription devices results in a direct negative impact on the public health, and exposes consumers to unnecessary risks from laser radiation.

Notice is hereby given that the Bureau of Radiation Control (bureau), Texas Department of Health (department), issued a notice of violation and proposal to assess an administrative penalty to Healthsouth Corporation, doing business as Healthsouth Katy Diagnostic (registrant-M00102) of Katy for violating the Texas Regulations for Control of Radiation. A total penalty of $1,400 is proposed to be assessed to the registrant for performing mammographic examinations without having a valid certification.

Using a mammography system without proper certification results in unauthorized equipment being used for the application of radiation to the members of the public. Low Income Home Energy Assistance Program (LIHEAP)/Weatherization Assistance Program for Low-Income Persons (WAPFLIP)

I. SUMMARY

The Texas Department of Housing and Community Affairs (Department) is issuing this Request for Proposals (RFP) to announce the availability of Department of Energy and Department of Health and Human services funds for the Weatherization Assistance Program for Low-Income Persons (WAP). These funds are to provide weatherization services to low income households residing in Dallas County. As of the date of this RFP, the Department intends to make an estimated $428,010 from FFY '99 funds available to eligible applicant, as defined in this RFP.

II. ELIGIBLE APPLICANTS

1. Any local public or private nonprofit agency.

2. Special consideration will be given to entities receiving federal funds under any low-income assistance program or weatherization assistance program under the Economic Opportunity Act of 1964 or any other provision of law on day before enactment of this Act.

Invitation to Comment

The Texas Natural Resource Conservation Commission (TNRCC) announces the availability of the second draft 1999 Clean Water Act (CWA), §303(d) list of impaired and threatened water bodies in the state. The §303(d) list is developed and promulgated pursuant to the requirements of the federal CWA, §303(d). The list is used to select water bodies for which total maximum daily load (TMDL) analyses and management actions will be initiated during the next two years. In addition to the §303(d) list, a secondary list of water bodies that demonstrate some cause for concern (the concerns list) is also available; these water bodies may, with additional data, be added to the final §303(d) list. Previous solicitation of public comment was conducted in November and December 1998 on the first draft of the 1999 §303(d) list.

Local residents, interest groups, or other organizations may have knowledge of specific problems, programs, or conditions unknown to TNRCC staff that should be considered to finalize the list. Useful information may include additional threats to water quality and water resources or additional data that depicts the quality of the water body. Anyone interested in submitting data or information should access the TNRCC website (see address, as follows) for detailed guidance on how to submit data to the TNRCC.

Additional information may result in: removal of a water body from the draft §303(d) list; addition to the final §303(d) list of other water bodies not on the draft §303(d) list or the concerns list; movement of a water body from the concerns list to the final §303(d) list; or change in the priority ranking assigned to each water body for TMDL development.

After the 30-day public comment period, the TNRCC will evaluate any additional data or information received. If any additional data or information submitted influences the second draft list in one of the four ways listed in the previous paragraph, this will be reflected in the final §303(d) list. The final §303(d) list will be sent to the United States Environmental Protection Agency (EPA) for approval in April 1999.

In accordance with the TNRCC's five-year water quality management cycle, the 1999 list focuses on water bodies in the following river basins and their associated coastal basins: Brazos, Colorado, Lavaca, Guadalupe, San Antonio, Nueces and Rio Grande. Comments on these water bodies are encouraged.

City of San Angelo, P.O. Box 1751, San Angelo, Texas 76902-1751 has applied for a minor amendment to Permit No. MSW 79 to change the site operating plan for their landfill. The 1.26-acre leachate evaporation pond is located on the southwest corner of the site, which is approximately 1.24 miles east of Fredericksburg, one mile east of the junction of FM Road 1631 with U.S. Highway 290, and adjacent to and south of FM Road 1631 in Gillespie County, Texas.

The Executive Director of the TNRCC has prepared draft permits which, if approved, will authorize the minor amendments to these permits.

The commission proposes the repeal of Chapter 120, because the chapter duplicates the rules in 30 TAC Chapter 335, Subchapter L. Chapter 120 and Chapter 335, Subchapter L, are joint rules for the control of air pollution from hazardous waste or industrial (solid) waste management facilities. The two sets of rules were first adopted by the Texas Air Control Board and the Texas Water Commission in 1986, under requirements of the Solid Waste Disposal Act. The two sets of rules, which contained the same permitting requirements, were needed for "one-stop" permitting until the two agencies merged on September 1, 1993, creating the commission.

The need for the repeal of Chapter 120 was identified during the course of the commission's review of these rules in accordance with the rules review requirement in the General Appropriations Act. The General Appropriations Act, Article IX, §167, requires all state agencies to review and readopt their rules every four years. At a minimum, state agencies must determine whether the reason for adopting the rules continues to exist. The staff has reviewed these joint rules and has determined that the agency no longer needs two sets of rules containing the same requirements.

NOTICE: This formal Notice of Award of consulting services is filed under the provisions of Government Code, Chapter 2254. In the November 13, 1998, issue of the Texas Register (23 TexReg 11735), the Field Operations Division of the Office of Compliance and Enforcement at the Texas Natural Resource Conservation Commission (TNRCC) announced that it would be issuing a "Request for Proposals (RFP) Relating to Consulting Services (Air/Water/Waste)" to qualified companies/organizations to perform a strategic assessment and management review of the business systems and procedures involved in the Site Inspection process of each of its program areas. The Consultant will conduct a Current System Analysis to objectively review current development efforts undertaken by the Agency. The Consultant will then analyze business processes, benchmark best practices, identify efficiencies and inefficiencies associated with the current structure, and evaluate opportunities to improve performance, and reduce redundancies. The Consultant will make recommendations for changes in business practices and organizational structure to utilize in the Agency's effort to construct a more unified inspection process.

TNRCC has awarded a Contract to: Information Engineering Group, Inc., 1507 Osprey Ridge Loop, Lago Vista, Texas 78645, to perform the consulting services described above. The total value of this Contract is $74,000.00 . The contract began on January 11, 1999 , and will end upon the performance of services, which shall be March 26, 1999 , unless otherwise authorized, in writing, by the TNRCC. The Executive Director of the TNRCC has reviewed each application for the permits listed and determined that sufficient water is available at the proposed point of diversion to satisfy the requirements of the application as well as all existing water rights. Any person or persons who own water rights or who are lawful users of water on a stream affected by the temporary permits listed above and who believe that the diversion of water under the temporary permit will impair their rights may file a complaint with the TNRCC. The complaint can be filed at any point after the application has been filed with the TNRCC and the time the permit expires. The Executive Director shall make an immediate investigation to determine whether there is a reasonable basis for such a complaint. If a preliminary investigation determines that diversion under the temporary permit will cause injury to the complainant the commission shall notify the holder that the permit shall be canceled without notice and hearing. No further diversions may be made pending a full hearing as provided in Section 295.174. Public Notice of Workshop on Investigation Into Possible Amendment of PUC Substantive Rule §23.150(G) and Request for Comments

The Public Utility Commission of Texas (PUC or commission) has initiated Project Number 20323, Investigation into Possible Amendment of PUC Substantive Rule §23.150(g) . The staff of the commission will hold a workshop regarding the appropriate treatment of Texas Universal Service Fund (TUSF) assessments on services purchased from an incumbent local exchange carrier (ILEC) by a payphone provider. The workshop will be held on Wednesday, February 24, 1999 from 9:00 a.m. until 11:00 a.m. in Hearing Room G, located on the 7th floor of the William B. Travis Building, 1701 North Congress Avenue, Austin, Texas 78701.

On November 12, 1998, the Texas Payphone Association, Inc. filed a petition to amend PUC Substantive Rule §23.150, Project Number 20088. Specifically, the petition requested that the commission amend PUC Substantive Rule §23.150(g)(5), concerning recovery of assessments, to add payphone providers to the list of retail customers from which telecommunications providers may not recover the amount of its TUSF assessment. The commission denied the petition at its January 12, 1999, open meeting. The commission further directed staff to hold a workshop and report back to the commission on the need for amendment of PUC Substantive Rule §23.150(g).

Prior to the workshop, the commission requests interested persons file comments by 3:00 p.m. Tuesday, February 16, 1999 on the following questions:

1. What current protections preclude a "double assessment" of TUSF charges on purchasers of wholesale services?

2. Are the services purchased from ILECs by payphone providers included in the ILECs' taxable telephone receipts under Chapter 151, Tax Code?

3. Is a payphone provider a retail or wholesale customer of an ILEC? Why?

4. Are ILECs paying TUSF assessments on services provided to payphone providers? If so, state the authority for this assessment.

5. Are ILECs assessing affiliated payphone providers the flow-through cost for the TUSF? If so, state the authority for this assessment.

6. Are payphone providers paying sales tax on the services purchased from ILECs? Please explain.

7. What types of lines are payphone providers purchasing from ILECs? Attach copies of applicable tariffs.

Southwest Texas State University (SWT) requests proposals for the disposition of two tracts of land. The settlement can be by means of long-term lease, exchange or sale of the properties. The first track is at the intersection of IH 35 and McCarty Lane. The property consists of 246.5 acres and is just north of the San Marcos Factory Shops and Outlet Mall. Attached is a map showing the location of the property and a site analysis description of the property. The second tract is at the intersection of McCarty Lane and Hunter Road (west side). The property consists of approximately 116 acres. Attached is a map and legal description of the property. Utilities are available to both tracts.

Southwest Texas State University will review proposals beginning March 1, 1999. Upon receipt and review of the proposals, SWT will enter into discussions with those who appear most promising for the purpose of determining a finalist. Specific contract terms will then be negotiated with one firm.

SWT expects a minimum market rate of return. SWT is conducting an independent market and appraisal analysis to use for comparison with proposals received. Proposed uses of the properties must be consistent with any environmental concerns in the area and compliant with any Federal or State restrictions in this regard.

The proposal should contain a brief description of the proposed use of the property, expected participation by SWT, and the projected financial return to SWT. It is acceptable to provide a range of potential returns to SWT, provided the scenario related to each one is adequately explained in the proposal.

The impact of property tax assessments will be the responsibility of the firm. Adequate insurance coverage will be required, as appropriate naming SWT as an additional insured. Performance bonds and/or other bond coverage to assure the viability of the arrangement may be required as deemed appropriate by SWT.

Request for Proposal: The Airport Sponsors listed comprising the Texas Regional Air Service Task Force, through their agent, the Texas Department of Transportation (TxDOT), intend to engage Aviation Professional Services pursuant to Chapter 2254, Subchapter A, of the Government Code. TxDOT, Aviation Division, will solicit and receive proposals for professional services to perform in-depth research and produce a study on "Small Market Air Service Needs Assessment" for the following cities:

Abilene, TX, Laredo, TX, Ruidoso, NM Alpine, TX, Longview, TX, San Angelo, TX, Brownwood, TX, Lubbock, TX, Sugar Land, TX, Carlsbad, NM, Lufkin, TX, Temple, TX, Clovis, NM, Killeen, TX, Texarkana, AK, Corpus Christi, TX, McAllen, TX, Tyler, TX, Del Rio, TX, Midland, TX, Victoria, TX, Hobbs, NM, Nacogdoches, TX, Waco, TX, Galveston, TX, New Braunfels, TX, Wichita Falls, TX, Georgetown, TX, and Roswell, NM

The study will focus on existing air services and the corresponding economic impact on participating communities that have no scheduled commercial passenger air service, or service deemed to be inadequate, limited in capability for the local market, or overpriced. Passenger leakage, quality of service, and capacity will also be examined. The study will serve to accurately identify community shortfalls and will provide reliable, unbiased third-party data that can be used by each community to address those shortfalls in order to strengthen their position when approaching airlines or when being considered by airlines.

Project Scope:

a. Analyze existing scheduled commercial passenger air service at participating non-hub and small hub airports, and document the air service needs of communities having no scheduled commercial air service, inadequate service (in terms of frequency or equipment), or service deemed overpriced,

b. Analyze existing airline pricing and yield structures in all participating markets and assess the related impact on passenger leakage and the quality and quantity of air service in those markets,

c. Identify potential airport changes for current airline service and airline pricing policies in communities reporting substantial loss of traffic and revenue due to passenger leakage,

d. Identify, through discussions with airline representatives, the general criteria required by an airline to serve a particular community, and

e. document, based on the criteria identified, the shortfalls of the participating communities and make recommendations as to how each community can address those shortcomings.

All activities will be closely coordinated with the Regional Air Service Task Force.

Proposal Shall Include:

1. Firm name, address, phone number and person to contact regarding the proposal.

2. Proposed project management structure identifying key personnel and subconsultants (if any).

3. Qualifications and recent, relevant experience (past five years) of the firm, key personnel and subconsultants relative to the performance of similar services.

4. Proposed project schedule, including major tasks and target completion dates.

5. Technical approach - a detailed discussion of the tasks or steps to accomplish the project.

6. List references including the name, address and phone number of the person most closely associated with the firm's prior performance of similar airport studies.

7. Statement regarding an Affirmative Action Program.

8. Certification that all franchise taxes are paid or that consultant is not subject to franchise taxes. Evidence shall be a certification from the State Comptroller entitled "Franchise Tax Certificate of Account Status".

9. Certification of Child Support payments required by Senate Bill 84, 73rd Legislature. Forms are available by calling TxDOT, Grant Management, at (512) 416-4500 or 1-800-68-PILOT.

10. Disadvantage Business Enterprise (DBE) 10% participation.

A mandatory pre-proposal meeting shall be held on February 18, 1999, at 200 E. Riverside Drive, Bldg. 200, Room 101, Austin, Texas 78704 at 1:30 p.m.. Proposals shall be accepted only from those individuals or firms in attendance.

Interested consultants should submit eleven copies of brief proposals consisting of the minimum number of pages sufficient to provide the above information. Proposals must be postmarked by U. S. The Regional Air Service Task Force committee will review all proposals and may select three to five firms for interviews. The final consultant selection by the Regional Air Service Task Force committee will be made following the completion of the review of proposals and/or interviews.

The Regional Air Service Task Force committee reserves the right to reject any or all proposals, and to reopen the consultant selection process.
