THE STATE OF TEXAS EXECUTIVE DEPARTMENT OFFICE OF THE GOVERNOR AUSTIN, TEXAS, EXECUTIVE ORDER GWB 98-5

RELATING TO THE EMERGENCY SUSPENSION OF REGULATORY STATUTES AND RULES

Under the provisions of the Texas Disaster Act of 1975 (Chapter 418.016 of the Texas Government Code) and the Emergency Disaster Proclamation, dated August 26, 1998, issued in response to the flooding affecting Val Verde County, Texas and the city of Del Rio, Texas and the surrounding areas, I, George W. Bush, Governor of Texas do hereby suspend normal state procurement procedures regarding goods and services needed in connection with meeting the disaster affecting Val Verde County, Texas and the city of Del Rio, Texas and the surrounding area. This action is taken in order to provide the most effective and efficient reaction to the disaster in the provision of goods and services necessary to ensure minimal loss of life, health, and property during this time of disaster. This order is being issued to ensure that existing procedures do not in any way prevent, hinder, or delay necessary action in coping with this disaster.

Where and when possible, and person responsible for making procurement under this order will attempt to verify that pricing is fair, and that no provider is taking advantage of the State of Texas or political subdivisions of the state. However, the safety and welfare of our citizens must be the single most important consideration in these procurements and therefore, those concerns should take precedent over all other considerations.

This order will remain in effect until rescinded or modified by me.
