The Interagency Council on Early Childhood Intervention (ECI) proposes an amendment to §621.21, concerning purpose. The amendment is proposed to reflect changes in statutory revisions by the 75th Legislature.

Donna Samuelson, Deputy Executive Director, Interagency Council on Early Childhood Intervention, has determined that for the first five-year period the amendment is in effect there will be no fiscal implications for state or local government as a result of enforcing or administering the amendment.

Ms. Samuelson also has determined that for each year of the first five years the amendment is in effect the public benefit anticipated as a result of enforcing the rule will be a current and concise rule. There will be no effect on small businesses. There are no anticipated economic costs to persons who are required to comply with the amendment as proposed.

Comments on the proposal may be submitted to Alex Porter, General Counsel, Interagency Council on Early Childhood Intervention, 4900 North Lamar Boulevard, Austin, Texas 78751-2399.

The amendment is proposed under the Human Resources Code, Chapter 73, which provides the Interagency Council on Early Childhood Intervention with the authority to promulgate rules consistent with the Code.

No other statutes, articles or codes are affected by the proposed amendment.

§621.21.Purpose.

These sections are intended to implement the provisions of the Interagency Council on Early Childhood Intervention [ Services ] Act, Human Resources Code, Chapter 73, and the Individuals with Disabilities Education Act, Part C [ H ] (Public Law 105-17), [ 102-119 and all subsequent amendments) ] which established a statewide system of early childhood intervention comprehensive services for children with developmental delay.

This agency hereby certifies that the proposal has been reviewed by legal counsel and found to be within the agency's legal authority to adopt.

Subchapter E. Early Childhood Intervention Service Delivery for Milestones Services

(Editor's note: The text of the following sections proposed for repeal will not be published. The sections may be examined in the offices of the Interagency Council on Early Childhood Intervention or in the Texas Register office, Room 245, James Earl Rudder Building, 1019 Brazos Street, Austin.)

The Interagency Council on Early Childhood Intervention (ECI) proposes the repeal of §§621.81-621.84, concerning Early Childhood Intervention Service Delivery for Milestones Services. The rules are no longer necessary and are therefore being repealed. Elsewhere in this issue of the Texas Register the ECI is contemporaneously proposing the review of Subchapter E. Early Childhood Intervention Service Delivery for Milestones Services, §§621.81-621.84. This review is in accordance with the Appropriations Act of 1997, HB 1, Article IX, Section 167.
