Request for Proposals (RFP)

The Children's Trust Fund of Texas, a state agency, (hereinafter referred to as CTF) is currently seeking proposals to implement programs to prevent Shaken Baby Syndrome (SBS) in Texas.

Shaken Baby Syndrome is a serious form of Abusive Head Trauma that occurs when a child is shaken by the arms, legs, or shoulders with or without impact of the head against either a soft or hard surface. Abusive Head Trauma is the leading cause of death and disability among abused infants and children. As the child is shaken back and forth in a whiplash motion, the undeveloped brain bumps back and forth inside the skull. This trauma can cause bleeding over the brain and/or within the eyes and brain swelling, which results in a traumatic brain injury. There may be no outward signs of abuse. SBS can result in brain damage, blindness, cerebral palsy, hearing loss, severe learning disabilities, seizures, permanent vegetative state, and death.

Shaken Baby Syndrome often occurs in combination with other abuse against a child. One of the major triggers for the shaking abuse of a child is the frustration often generated by a baby's continuous crying or irritability. Potty training is another source of aggravation for caretakers that lead to the shaking of a child. All caregivers must have access to education on the dangers of shaking children. Taking care of a child is a big responsibility. It can also be frustrating, especially when a baby will not stop crying. Educating caregivers on what to do when a child is crying, helping them to understand normal stages of child development, and providing tips on how to maintain control of emotions are an important part of preventing SBS.

Deadline: Deadline for submission of proposals is September 30, 1999 at 5:00 PM.

Contract Period: The contract period for the first year is a nine-month period (December 1, 1999 - August 31, 2000). Contracts will be considered for renewal for two additional years as authorized by the CTF Council. Renewal is not automatic and renewal applications will be requested.

Eligibility Criteria: To be eligible to apply for funding, an applicant must:

1. be able to provide a cash or in-kind match equal to at least 10% of the grant amount the first year. An applicant may not use state funds to meet the match obligation; however, federal funds may be used.

2. be a legally constituted entity, other than a state agency. As mandated by law, a state agency may not apply for a CTF grant.

A State Agency is defined as a board, commission, department, office, or other state agency that:

* is in the executive branch of state government

* was created by the constitution or statute of this state and

* has statewide jurisdiction.

Special consideration will be given to youth organizations.

Amount of Contract Awards: Grants are available up to $10,000 with a portion of this amount dedicated solely to extensive training, curriculum materials, and technical support.

Evaluation and Selection: Applications that meet the initial screening process will be reviewed and scored by a review team and selected and approved by the CTF Council. Applicants will be notified in November 1999 of the status of their request.

Notice and Opportunity to Comment on Requests for Consistency Agreement/Concurrence under the Texas Coastal Management Program

On January 10, 1997, the State of Texas received federal approval of the Coastal Management Program (CMP) (62 Federal Register pp. 1439-1440). Under federal law, federal agency activities and actions affecting the Texas coastal zone must be consistent with the CMP goals and policies identified in 31 TAC Chapter 501. Requests for federal consistency review were received for the following projects(s) during the period of July 23, 1999, through July 30, 1999:

FEDERAL AGENCY ACTIONS:

Applicant: Sonat Exploration Company; Location: The project is located in High Island Blocks 14-L and 17-L, Offshore, Gulf of Mexico, Texas CCC Project Number: 99-0263-F1; Description of Proposed Action: The applicant proposes to abandon in place 15 pipelines in Blocks 14L and 17L. The pipelines were authorized under three separate Department of the Army Permits, 9962, 13094, and 13528; Type of Application: U.S.A.C.E. permit application number 21671 under §10 of the Rivers and Harbors Act of 1899 (33 U.S.C.A. 403).

Applicant: Alcoa World Alumina Atlantic; Location: The project is located on the existing R52 Bulk Loading Dock, at the Alcoa facilities, on Lavaca Bay, State Tract No. 25, one mile south of State Highway 35, Calhoun County, Texas; CCC Project Number: 99-0266-F1; Description of Proposed Action: The applicant proposes to amend the existing Department of the Army Permit 19201 to reconfigure the existing dock facilities by removing the existing mooring dolphins and end clusters; installing new mooring dolphins, monopiles, gangways; and extending the existing dock. There will be no dredging, fill or wetland impacts associated with this project; Type of Application: U.S.A.C.E. permit application number 19201(01) under §10 of the Rivers and Harbors Act of 1899 (33 U.S.C.A. 403).

Applicant: Angelo Montalbano; Location: The project is located in Bolivar Roads, adjacent to Boddecker Drive, approximately 200 feet east of Seawall Boulevard, Galveston, Galveston County, Texas; CCC Project Number: 99-0267-F1; Description of Proposed Action: The applicant proposes to mechanically dredge 3,500 cubic yards (CY) of new work material from a 392-foot-long by 116-foot-wide area between an existing sand spit and Galveston Entrance, South Jetty, to a depth of -6 feet mean high tide (MHT). Additionally, the applicant proposes to construct three 64-foot-long by 4 foot-wide piers, a 24- foot-long by 4- foot-wide pier on existing pilings, a 42-foot-long by 4-foot-wide pier on existing pilings, and a 42- foot-long by 32- foot-wide boat ramp; Type of Application: U.S.A.C.E. permit application number 21679 under §10 of the Rivers and Harbors Act of 1899 (33 U.S.C.A. 403), and §404 of the Clean Water Act (33 U.S.C.A. §§125-1387).

Applicant: Brazos River Harbor Navigation District; Location: The project is located at the Freeport Harbor in the Brazos Harbor Channel near the intersection of FM 1495 and SH 288 in Freeport, Brazoria County, Texas; CCC Project Number: 99-0268-F1; Description of Proposed Action: The applicant proposes to use one of three options (two-way slab open wharf, box beam open wharf, and caisson wharf) for a 100-foot-wide by 500-foot-long wharf and to perform associated dredging at the Port of Freeport; Type of Application: U.S.A.C.E. permit application number 21740 under §10 of the Rivers and Harbors Act of 1899 (33 U.S.C.A. 403), and §404 of the Clean Water Act (33 U.S.C.A. §§125-1387).

FEDERAL AGENCY ACTIVITIES:

Applicant: CORPS - New Nationwide Permits; CCC Project Number: 99-0271-F2; Description of Proposed Activity: On 21 July 1999, the Corps published a notice, in Part III of the Federal Register, announcing a revised proposal to issue 5 new Nationwide Permits (NWPs) and modify 6 existing NWPs, and to replace NWP 26, the expiration date of which has been extended to 30 December 1999, or the effective date of the new and modified NWPs, whichever comes first. In this Federal Register notice, the Corps also proposes to add 3 new general conditions to the NWPs to increase protection of the aquatic environment. The proposed NWPs are activity-specific and authorize certain activities in non-tidal waters of the United States that have minimal adverse effects on the aquatic environment. The proposed NWP general conditions will restrict or prohibit the use of certain NWPs in waters of the United States, 100-year floodplains, impaired waters, and designated critical resource waters.

The Federal Register notice also describes a revised process and schedule for issuing and implementing the new and modified draft NWPs, including regional conditions. Concurrent with this Federal Register notice, Corps Districts will be announcing draft Corps regional conditions for these NWPs for public comment. When the new and modified NWPs are issued, the final Corps regional conditions will be issued at the same time so that the States and Tribes can make their Section 401 water quality certification and Coastal Zone Management Act (CZMA) consistency determination decisions. The 401/CZMA decisions must be made within 60 days of the Federal Register notice announcing the issuance of the new and modified NWPs. After this 60-day period, the new and modified NWPs, and Corps regional conditions, will become effective.

Applicant: CORPS - Gulf Intracoastal Waterway widening and restoration of bay depth at two placement areas, Matagorda Bay and San Antonio Bay, Texas; CCC Project Number: 99-0272-F2; Description of Proposed Activity: This public notice is issued in accordance with the provisions of Federal regulations, Title 33 CFR 337.1 and Title 40 CFR 230, concerning the policy, practice, and procedures to be followed by the Corps of Engineers in connection with placement of dredged or fill material in navigable waters.

This public notice supplements PUBLIC NOTICE NO. IWW-M-10, which described maintenance dredging of the Gulf Intracoastal Waterway (GIWW) between Matagorda Bay and San Antonio Bay, Texas. The purpose of this notice is to inform the public that dredging is proposed to widen the existing GIWW east of the Matagorda Ship Channel (MSC), and to restore natural bay depth near the junction of the GIWW and the MSC and the Channel to Palacios. The purpose of this dredging activity is to alleviate safety hazards for shipping in this area of strong currents.

Pursuant to §306(d)(14) of the Coastal Zone Management Act of 1972 (16 U.S.C.A. §§1451-1464), as amended, interested parties are invited to submit comments on whether a proposed action is, or is not consistent with the Texas Coastal Management Program goals and policies, and whether the action should be referred to the Coastal Coordination Council for review. Pursuant to Chapter 2254, Subchapter B, Texas Government Code, the Comptroller of Public Accounts (Comptroller) announces the issuance of its Request for Proposals (RFP) for the performance of a management and performance review of the Austin Independent School District (AISD). The services sought under this RFP will culminate in a final report, which report shall contain findings, recommendations, implementation timelines, plans, and be a component part of the review. Newton County is seeking requests for comments and proposals from interested parties interested in providing additional medicaid certified nursing facility bids.

House Bill 606, 75th Legislature, 1997, the State of Texas, permits a County Commissioners' Court of a rural county (defined as a county with a population of 100,000 or less) to request that the Texas Department of Human Services (TDHS) contract for additional Medicaid nursing facility beds in that county. This may be done without regard to the occupancy rate in available beds in the county.

Newton County Commissioners' Court is considering desirability of requesting that TDHS contract for more Medicaid nursing facility beds in Newton County. The Commissioners' Court is soliciting comments from all interested parties on the appropriateness of such a request. Additionally, the Commissioners' Court seeks to determine if qualified entities are interested in submitting proposals to provide these additional Medicaid certified nursing facility beds. Notice of Intent to Extend Contract for the Texas Library Connection

Description. The Texas Education Agency (TEA) solicited a contractor through Request for Proposals (RFP) number 701-95-017 for developing, maintaining, and making accessible over the Internet, a United States Machine Readable Catalog (USMARC) database of school library holdings. The RFP appeared in the January 24, 1995, issue of the Texas Register (20 TexReg 393). A Notice of Intent to Extend Contract for the Texas Library Connection (TLC) appeared in the July 2, 1996, issue of the Texas Register (21 TexReg 6098); in the July 18, 1997, issue of the Texas Register (22 TexReg 6778); and in the July 3, 1998, issue of the Texas Register (23 TexReg 7106).

The contractor successfully completed the first four years of the project, creating the database and merging over thirty million records from 4,000 sites into over three million unique records. As additional libraries are accepted into the TLC, the process of merging records into the existing database will continue. Additional clean up of the database needs to occur to maintain the integrity of the USMARC records. Therefore, under the provisions of RFP number 701-95-017, TEA intends to award a continuation contract to the previous contractor, Auto-Graphics, Inc., of Pomona, California.

Dates of Project. The continuation contractor shall plan for a starting date of no earlier than September 1, 1999, and an ending date of no later than August 31, 2000.

Project Amount. The contractor may receive funding not to exceed $1,000,000 during the contract period. Subsequent project funding will be based on satisfactory progress of objectives and activities, on funding being available, and authorization to continue.

The issuance of this notice does not obligate the TEA to award a contract or pay any costs incurred in preparing a response.

Request for Applications Concerning 1999-2001 Investment Capital Fund Grant Program (formerly the Staff Development and Parent Training for Campus Deregulation and Restructuring to Improve Student Achievement Grant)

Eligible Applicants. The Texas Education Agency (TEA) is requesting applications under Request for Applications (RFA) number 701-99-016 from public school districts on behalf of an individual school campus or an open- enrollment charter school that has demonstrated a commitment to campus deregulation and to restructuring educational practices and conditions by entering into a partnership with representatives of all of the following entities: school staff; parents of students; community and business leaders; school district officers; a nonprofit, community-based organization that has a demonstrated capacity to train, develop, and organize parents and community leaders into a large, nonpartisan constituency that will hold the school and the school district accountable for achieving high academic standards; and TEA. A separate application, specific to the applying campus, must be submitted for each campus for which the district is applying. Any campus that has been selected or is operating a 1998-2001 Staff Development and Parent Training for Campus Deregulation and Restructuring to Improve Student Achievement grant is not eligible to apply for or to receive a 1999-2001 Investment Capital Fund grant.

Description. The purpose of this initiative is to assist eligible individual public school campuses in implementing practices and procedures consistent with deregulation and school restructuring to improve student achievement and in identifying and training parents and community leaders who will hold the school and the school district accountable for achieving high academic standards. Grants must be used for the training and development of school staff, parents, and community and business leaders in order that they understand and implement the: (a) academic standards and practices necessary for high academic achievement; (b) appropriate strategies to deregulate and restructure the school to improve student achievement; and (c) effective strategies to organize parents and community leaders into a large, nonpartisan constituency that will hold the school and the school district accountable for achieving high academic standards. Grantees must demonstrate: (1) the development and implementation of a comprehensive plan to engage in on-going development and training of teachers, parents, and community leaders to (a) understand academic standards, (b) develop effective strategies to improve academic performance, and (c) organize a large constituency of parents and community leaders to hold the school and school district accountable for achieving high academic standards; (2) on-going progress in achieving higher academic performance; and (3) on-going progress in identifying, training, and organizing parents and community leaders who will hold the school and the school district accountable for achieving high academic standards.

Dates of Project. The Investment Capital Fund Grant Program is to be carried out over a two-year period, beginning in the 1999-2000 school year. Applicants should plan for a starting date of no earlier than January 3, 2000, and an ending date of no later than January 2, 2001, for the initial year of funding. The second 12 months of the two-year project period would begin January 3, 2001, and end January 2, 2002.

Project Amount. Funding will be provided for approximately 175 projects. Each project will initially receive a maximum of $40,000. It is anticipated that grants awarded under this RFA will be eligible for up to 50% of the initial award amount in additional funding for school year 2000-2001. The additional funding is contingent upon the applicant's successful implementation of the proposed program and management of programmatic and fiscal responsibilities as stated in this RFA. Awardees must submit a continuation application to the agency describing progress toward achievement of the applicant's program objectives and the use of the additional funding to assist the school in achieving those objectives. This continuation application is subject to approval by TEA.

Selection Criteria. Each application will be reviewed to determine the capacity of the applicant to implement its proposed program. Applicants that have previously received grants from TEA to conduct special projects must have a positive record in successfully managing the program(s) in order to be considered for funding. All requirements of this RFA must be addressed. Each application will be reviewed to determine the capability of the school to implement a valid and cohesive local grant program that will promote training and development of school staff, parents, and community and business leaders in order that they understand and implement academic standards and practices necessary for high academic achievement, appropriate strategies to deregulate and restructure the school in order to improve student achievement, and effective strategies to organize parents and community leaders into a large, nonpartisan constituency that will hold the school and school district accountable for achieving high academic standards.

The TEA is not obligated to approve an application, provide funds, or endorse any application submitted in response to this RFA. This RFA does not commit TEA to pay any costs before an application is approved. The issuance of this RFA does not obligate TEA to award a grant or pay any costs incurred in preparing a response.

The Office of the Texas State Chemist/Texas Feed and Fertilizer Control Service proposed amendment to §61.61. The rule appeared in the August 6, 1999, issue of the Texas Register (24 TexReg 5967).

Due to Texas Register error, numbers were dropped after the less than (<) signs. Section 61.61 should read as follows.

General Land Office

Request for Qualifications

Effective September 1, 1999, Senate Bill 7, 76th Legislature, authorizes the Commissioner of the Texas General Land Office (GLO), under Chapter 35 of the Texas Utilities Code, to negotiate and execute contracts for the conversion of royalties taken in kind to other forms of energy including electricity for sale to public retail customers which include public school districts, state institutions of higher education, agencies of the state, and political subdivisions of the state (the Program).

Pursuant to Senate Bill 7, the commissioner is requesting the submission of qualifications of providers that can assist the GLO with all aspects of energy-related functions for the Program, including, but not limited to, the following:

(1) physical and financial aspects of converting royalties taken in kind to electricity;

(2) retail marketing, sales, billing, and metering;

(3) ancillary services necessary for the effective delivery to customers (including any future services required to serve the retail market);

(4) services on a specific regional and/or statewide basis to add the most value to the Program, and;

(5) innovative ideas to enhance the Program.

Texas Commission on Jail Standards

Request for Proposals

Pursuant to the Texas Government Code, Title 10, Article 2254, Subchapter B, the Commission on Jail Standards invites proposals for consulting services from qualified individuals to advise and assist TCJS in a survey of jails across the state under the terms of the Juvenile Justice and Delinquency Prevention Act, Public Law 93-415, as modified.

The individual selected will conduct on-site analyses of records and facilities at approximately 60 county and municipal jails and prepare required documentation and reports to verify compliance information regarding the removal of juveniles from the facilities. The selected consultant shall report directly to Jack Crump at the Texas Commission on Jail Standards.

All work performed under this contract shall be reimbursed on an hourly basis and is expected to be completed by August 31, 2000.

Travel expenses shall be reimbursed upon state per diem rates with direct operating expenses provided by TCJS.

The Texas Natural Resource Conservation Commission (TNRCC) announces the availability of the Draft May 1999 Update of the Texas Nonpoint Source Pollution Assessment Report and Management Program.

The Nonpoint Source Pollution Assessment Report and Management Program is developed pursuant to the requirements of §319 of the federal Clean Water Act (CWA). The Draft May 1999 Update of the Texas Nonpoint Source Pollution Assessment Report and Management Program identifies goals and objectives to guide nonpoint source program activities designed to establish a priority listing of impaired waters for remedial or protective action.

If the permit is granted, the applicant would be authorized to dispose of municipal solid waste resulting from or incidental to municipal, community, commercial, institutional, recreational activities, and construction or demolition projects; Class 1 industrial wastes; special waste that are properly identified. The facility would be authorized to operate 24 hours a day 7 days a week

The TNRCC Executive Director determined the application to be administratively complete on July 26, 1999 and will conduct a technical review of the application. The Commission will issue additional notice of the application and the terms of any proposed draft permit once the technical evaluation is completed. The additional notice will describe procedures for public participation.

Notice of Application

THE CITY OF ROBERT LEE (ROBERT LEE WATERWORKS), P.O. Box 26, 6 East 7th Street, Robert Lee, Texas 76945 has applied to the Texas Natural Resource Conservation Commission (TNRCC) to amend Certificate of Adjudication Number 14-1023. Certificate of Adjudication 14-1023 currently includes authorization for the City of Robert Lee (Robert Lee Waterworks) to divert and use not to exceed 42 acre-feet of water per annum for municipal purposes from a water well located in the old river channel which taps the underflow of the Colorado River and from a specific point on the North Bank of the Colorado River downstream of E. V. Spence Reservoir in Coke County, Texas at a maximum rate of diversion of 0.17 cfs (78 gpm). In addition, the City of Robert Lee has a Water Supply Contract with the Colorado River Municipal Water District (TNRCC Contract Number 426) for diversion and use of a maximum of 50 acre-feet of water per year for municipal purposes from E. V. Spence Reservoir on the Colorado River in Coke County at a maximum diversion rate of 0.74 cfs (330 gpm). During drought conditions, the level of E. V. Spence Reservoir drops to the point that the City of Robert Lee cannot divert water from the lake and Robert Lee Waterworks does not have facilities to divert water from the diversion point included in Certificate Number 14-1023. The City of Robert Lee (Robert Lee Waterworks) seeks to amend Certificate Number 14-1023 by adding a diversion point on Messbox Creek, tributary of the Colorado River, Coke County, Texas. Water from the Colorado River is backed up into Messbox Creek. This point is approximately 400 feet downstream of the dam for the E. V. Spence Reservoir, 1 mile West Northwest of the Coke County Courthouse, and is S 21½W, 1038 feet from the East Corner of the Samuel A. Maverick Original Survey Number 985, Abstract Number 541, Coke County, Texas also being 31.593½N Latitude and 100.33½W Longitude. The City of Robert Lee is also requesting authorization to divert their contract water at this point. The "certificate" and contract water would be diverted at a maximum rate of 0.74 cfs (330 gpm). The requested diversion point is on land the applicant does not own, but the landowners have consented to the granting of this amendment. Fees have been paid and no other changes are requested. This notice is being sent to you as owner of one of two water rights with a diversion point on the Colorado River between the existing diversion point and the requested additional diversion point. Any proposed amendment to the application will include a condition that it be junior in priority to the two interjacent water rights in the Colorado River Watershed and will also be subject to the continuing consent of the owners of the property where the new diversion point is located.

Notice Of Partial Application For Land Use-Only Determination for a Municipal Solid Waste Landfill

For The Period of July 16, 1999

The Applerock Group, L.L.C., has submitted a partial application to the Texas Natural Resource Conservation Commission (TNRCC) for a permit (Proposed Permit Number MSW-2276) to authorize a new Type IV municipal solid waste landfill facility. The applicant has requested a land use-only determination pursuant to Health and Safety Code Section 361.069 and has submitted Parts I and II of the application as required by 30 TAC Section 330.51(a) and 30 TAC Section 330.61. The proposed facility is located northeast of the intersection of State Highway 3 and Genoa Red Bluff Road at 313 Genoa Red Bluff Road (Latitude 29o 37' 31" north, longitude 95o 11' 48" west). The landfill will encompass approximately 100 acres including waste fill area, interior access roadways, perimeter buffer areas, easements, drainage features and other site appurtenances. The area designated for waste fill is approximately 80 acres in size and its boundaries are defined in the application. The proposed facility will contain fill approximately 40 feet deep, with subsurface side slopes of 3:1 (horizontal to vertical). Aerial fill will be authorized with 4:1 side slopes and a maximum height above natural ground not to exceed 50 feet. The estimated waste capacity will be 4.1 million cubic yards. It is estimated that the facility will receive an average of 650 tons of waste per day and can include brush, construction or demolition waste, and/or rubbish that are free of putrescible wastes and free of household wastes. The hours of operation will be Monday through Saturday from 7:00 a.m. to 7:00 p.m. The proposed landfill will be required to comply with TNRCC regulations regarding ground water protection, ground water monitoring, site operations, landfill gas monitoring, financial assurance, and closure/post closure care. The Executive Director of the TNRCC has determined that Parts I and II of the application are technically complete for the purpose of a land use-only determination. A copy of the partial application is available for inspection in the Office of the Chief Clerk, Texas Natural Resource Conservation Commission, 12100 Park 35 Circle in Austin, Texas.

The following issues will be considered to have been resolved in Parts I and II of the partial application: any issue related to land use compatibility, including but not limited to: any zoning at the proposed site or in the vicinity, any county land use ordinances, growth trends in the area of the proposed site, any issues related to the proximity of residences and other uses (e.g. schools, churches, cemeteries, historic structures and sites, archaeologically significant sites, sites having exceptional aesthetic quality, etc.), conformance with this aspect of the regional solid waste management plan, other traditional land use factors associated with the public interest, geographic boundaries of the proposed site, maximum height of the proposed landfill, approximate volume of waste or estimated life of the facility, size of the proposed buffer zones, the proposed concept for visual screening as defined in the partial application, traffic impacts, landfill access, impact on airports, and all applicable location restrictions.

Notice is hereby given that pursuant to the requirements of Texas Water Code, §5.103 and §5.105, which provide the Texas Natural Resource Conservation Commission (commission) with the authority to adopt any rules necessary to carry out the powers and duties under the provisions of the Texas Water Code and other laws of this state; and §26.039(f), which requires the commission by rule to specify the conditions under which a spill from a wastewater treatment or collection facility owned or operated by a local government must be reported to appropriate local government officials and local media, the commission will conduct a public hearing to receive testimony regarding proposed new 30 TAC Chapter 319, Subchapter C, concerning Public Notice of Spills or Accidental Discharges from Wastewater Facilities Owned or Operated by Local Governments.

The proposed new subchapter will implement the provisions of House Bill 1074, 76th Legislature (1999), which requires the notification of appropriate local officials and local media in the event of a spill from a wastewater treatment or collection system owned or operated by a local government which may adversely affect a source of drinking water.

The draft permit authorizes the discharge of treated domestic wastewater at a daily average flow not to exceed 240,000 gallons per day. The plant site is located northeast of the City of Canadian, about 0.5 mile east of U.S. Highway 60, and one mile of Farm-to-Market Road 2388 at the east end of the golf course and fairgrounds in Hemphill County, Texas.

CANUTILLO INDEPENDENT SCHOOL DISTRICT has applied for a Texas Pollutant Discharge Elimination System (TPDES) wastewater permit. The applicant has an existing Texas Natural Resource Conservation Commission (TNRCC) Permit Number 11561-002. The draft permit authorizes the discharge of treated domestic wastewater at a daily average flow not to exceed 45,000 gallons per day. CITY OF COMMERCE has applied for renewal of an existing wastewater permit. CITY OF DAINGERFIELD has applied for renewal of an existing wastewater permit. The applicant has an existing National Pollutant Discharge Elimination System (NPDES) Permit Number TX0027031 and an existing Texas Natural Resource Conservation Commission (TNRCC) Permit Number 10499-001. The draft permit authorizes the discharge of treated domestic wastewater at a daily average flow not to exceed 70,000 gallons per day. The Texas Pollutant Discharge Elimination System (TPDES) Permit Number 10741-001 will replace the existing NPDES Permit Number TX0054721 issued on April 10, 1993 and TNRCC Permit Number 10741-001. The plant site is located approximately 1,000 feet south of U.S. Highway 271 and 1400 feet west of the intersection of Farm-to-Market Road 1149 and U.S. Highway 271 in Lamar County, Texas.

DEVEREUX FOUNDATION, has applied for renewal of an existing National Pollutant Discharge Elimination System (NPDES) Permit Number TX0075744 and has an existing Texas Natural Resource Conservation Commission (TNRCC) Permit Number 11411-001. The draft permit authorizes the discharge of treated domestic wastewater at an annual average flow not to exceed 39,000,000 gallons per day. The plant site is located approximately 4,000 feet southeast of the Riverside Canal headgates, north of the Rio Grande and 1.5 miles northwest of the abandoned Socorro Wastewater Treatment Plant in El Paso County, Texas.

ELGIN BUTLER BRICK COMPANY has applied to the Texas Natural Resource Conservation Commission (TNRCC) for a renewal of TNRCC Permit Number 01414, which authorizes the discharge of groundwater and storm water on an intermittent and flow variable basis via Outfall 001. Issuance of this Texas Pollutant Discharge Elimination System (TPDES) permit will replace the existing TNRCC Permit Number 01414, issued on September 2, 1994. The applicant operates a clay mining and structural brick/tile manufacturing facility. ELYSIAN FIELDS INDEPENDENT SCHOOL DISTRICT has applied for a major amendment to TNRCC Permit Number 12663-001 to authorize an increase in the discharge of treated domestic wastewater from a daily average flow not to exceed 7,000 gallons per day to a daily average flow not to exceed 10,000 gallons per day. The current permit authorizes the discharge of process wastewater, cooling tower blowdown, boiler blowdown, and storm water via Outfall 001 at a volume not to exceed 1.5 MGD. CITY OF HAMILTON has applied for a renewal of TNRCC Permit Number 10492-002, which authorizes the discharge of treated domestic wastewater at a daily average flow not to exceed 440,000 gallons per day. The applicant has also requested a temporary variance to the existing water quality standards to allow time for the TNRCC to adopt a site specific standard for Pecan Creek for incorporation into 30 TAC §307.10, Appendix D. The renewed permit also authorizes a variance to the Texas Surface Water Quality Standards under 30 TAC 307.2(d)(4). The variance would authorize a three-year period in which the Commission will consider a recommended site-specific standard for Pecan Creek and determine whether to adopt the standard or require the existing water quality standard to remain in effect. The plant site is located approximately 1,900 feet east of U.S. Highway 281 in the City of Hamilton and immediately south of Pecan Creek at a point 2,800 feet north of State Highway 36 in Hamilton County, Texas.

The draft permit authorizes the discharge of non-contact cooling water, boiler blowdown and storm water runoff at a daily average flow not to exceed 225,000 gallons per day. The plant site is located at State Highway (S.H.) 271 and Dean Street, on the west side of S.H. 271 at a point approximately 1,000 feet south of its intersection with S.H. 300, in the City of Gilmer in Upshur County, Texas.

CITY OF SAN BENITO has applied for a renewal of TNRCC Permit Number 10473-002, which authorizes the discharge of treated domestic wastewater at a daily average flow not to exceed 2,160,000 gallons per day. The applicant has also requested a temporary variance to the existing water quality standards to allow time for the TNRCC to adopt a site specific standard for the drainage ditch for incorporation into 30 TAC §307.10, Appendix D. The draft permit authorizes the discharge of treated domestic wastewater at an annual average flow not to exceed 2,160,000 gallons per day. The renewed permit also authorizes a variance to the Texas Surface Water Quality Standards under 30 TAC 307.2(d)(4). The variance would authorize a three-year period in which the Commission will consider a recommended site-specific standard for the drainage ditch and determine whether to adopt the standard or require the existing water quality standard to remain in effect. The plant site is located approximately 1.5 miles northeast of the intersection of State Highway 448 and Farm-to-Market Road 1846 between the northern termination of Mayfield Road and Farm-to-Market Road 1846 in Cameron County, Texas.

SILVERLEAF RESORTS INC. has applied for renewal of an existing wastewater permit. The applicant has an existing National Pollutant Discharge Elimination System (NPDES) Permit Number TX0089362 and an existing Texas Natural Resource Conservation Commission (TNRCC) Permit Number 12482-001. CITY OF SLATON has applied for a renewal of Permit Number 10284-001, which authorizes the disposal of treated domestic wastewater at a total daily average flow not to exceed 910,000 gallons per day. Flow is split with a maximum daily average flow of 210,000 gallons per day used to irrigate 50-acres golf course and 700,000 gallons per day used for disposal by irrigation on 192 acres of agricultural lands. The wastewater treatment facilities and disposal site are located approximately 1.1 miles northeast of the intersection of State Highway-Loop 251 and Farm-to-Market Road 41, 0.9 miles north-northeast of the intersection of Division Street and Golf Course Road in Lubbock County, Texas.

SOUTHERN CLAY PRODUCTS, INC. has applied for a renewal of an existing wastewater permit. The current permit authorizes the discharge of domestic waste at a daily average flow not to exceed 6,500 gallons per day via Outfall 001. Issuance of this Texas Pollutant Discharge Elimination System (TPDES) permit will replace the existing NPDES Permit Number TX0088528 issued on March 4, 1988 and TNRCC Permit Number 13326-001 issued July 16, 1993. The applicant operates a warehouse for the storage of oil field equipment. The applicant operates a bulk material storage facility that handles washed aggregate, petroleum coke, carbonaceous pitch, sand, and gravel. TRINITY BAY CONSERVATION DISTRICT has applied for a major amendment to TNRCC Permit Number 10851-001 to authorize an increase in the discharge of treated domestic wastewater from a daily average flow not to exceed 720,000 gallons per day to an annual average flow not to exceed 1,500,000 gallons per day and to authorize less stringent effluent limitations. The plant site is located approximately 1.2 miles southeast of the intersection of State Highway 124 and Farm-to-Market Road 1406 approximately 0.7 mile east of State Highway 124, on Buccaneer Drive, in the City of Winnie, in Chambers County, Texas.

UNITED STATES AIR FORCE BASE CONVERSION AGENCY has applied for a Texas Pollutant Discharge Elimination System (TPDES) wastewater permit. The applicant has an existing Texas Natural Resource Conservation Commission (TNRCC) Permit Number 03973. The draft permit authorizes the discharge of the discharge of treated groundwater at a daily average flow not to exceed 101,000 gallons per day via Outfall 001. CITY OF UVALDE has applied for renewal of an existing wastewater permit. The applicant has an existing National Pollutant Discharge Elimination System (NPDES) Permit Number TX0023094 and an existing Texas Natural Resource Conservation Commission (TNRCC) Permit Number 10306-001. The draft permit authorizes the discharge of treated domestic wastewater at an annual average flow not to exceed 2,500,000 gallons per day. The current permit authorizes the land application of sewage sludge for beneficial use on 55 acres. The sludge disposal site is located on crop land totaling approximately 55 acres adjacent to the plant site along the road entering the plant. The plant site is located approximately 1.3 miles southwest of the intersection of Farm-to-Market Road 117 and U.S. Highway 83 in Uvalde County, Texas.

TOWN OF VAN HORN has applied for renewal of the existing National Pollutant Discharge Elimination System (NPDES) Permit Number TX0107867 and has an existing Texas Natural Resource Conservation Commission (TNRCC) Permit Number 10721-001. The draft permit authorizes the discharge of treated domestic wastewater at a daily average flow not to exceed 405,000 gallons per day. The current permit also authorizes the disposal of treated domestic wastewater via irrigation of 45 acres. WEBB COUNTY has applied has applied for a Texas Pollutant Discharge Elimination System (TPDES) wastewater permit. Notice of Water Right Application

PUBLIC UTILITY BOARD OF BROWNSVILLE, 1425 Robinhood Drive, Brownsville, Texas 78520 has applied to the Texas Natural Resource Conservation Commission (TNRCC) to amend Permit Number 1838, as amended. Permit Number 1838A authorizes the applicant to divert and use not to exceed 40,000 acre-feet of water per year directly from the Rio Grande for municipal and industrial use in Cameron County, Texas. The time priority for the impoundment of water in off-channel reservoirs and use of water for industrial and municipal purposes is June 22, 1956. The applicant seeks to amend Permit Number 1838, as amended, by adding a third diversion point, at the current diversion point/facilities for the Cameron County WCID #6 pumping station, upstream of existing diversion points authorized pursuant to Permit Number 1838A in Cameron County, Texas. The Cameron County WCID #6 will divert the water in accordance with a memorandum of understanding. This amendment will be junior to all water rights with diversion points in the Rio Grande Basin between the original diversion point and the requested upstream diversion point. GUADALUPE-BLANCO RIVER AUTHORITY, 933 East Court Street, Seguin, Texas 78155, has applied to the Texas Natural Resource Conservation Commission to amend Certificate of Adjudication Number 18-2074, as amended, pursuant to §11.122 and §11.085 of the Texas Water Code, and Texas Natural Resource Conservation Commission Rules 30 TAC §§295.1, et seq. Under Certificate of Adjudication Number 18-2074, as amended (the Canyon Certificate), the Guadalupe-Blanco River Authority (GBRA) has the right to maintain a dam and reservoir on the Guadalupe River (Canyon Reservoir), impound water therein, and divert and use from the conservation storage in the reservoir, not to exceed 62,900 acre-feet of water in any year, provided that diversions may not exceed an average of 50,000 acre-feet of water per year over any five consecutive calendar year period (250,000 acre-feet of water during any five consecutive calendar year period) for municipal, domestic, industrial, irrigation, and recreation purposes. In the most recent amendment to the Canyon Certificate, GBRA was authorized to use the water anywhere within GBRA's ten-county statutory district, which consists of Hays, Comal, Guadalupe, Caldwell, Gonzales, DeWitt, Victoria, Kendall, Refugio, and Calhoun Counties. Portions of this ten-county district lie outside the Guadalupe River Basin, within the San Antonio, Colorado, and Lavaca River Basins, and the Colorado-Lavaca, Lavaca-Guadalupe, and San Antonio-Nueces Coastal Basins. The priority date of GBRA's right to impound water in Canyon Reservoir and to divert and use water therefrom for municipal, domestic, industrial irrigation, and recreation purposes anywhere within GBRA's ten-county statutory district is March 19, 1956. Because GBRA did not, in its most recent application to amend the Canyon Certificate, request deletion of the separate and duplicative transbasin diversion authorizations that existed prior to the granting of that application, those authorizations and their stated priority dates also remain, as follows: (1) The time priorities of GBRA's right to transfer 7,649 acre-feet of water per year for industrial purposes from the Guadalupe River Basin for use in the Lavaca-Guadalupe Coastal Basin, are as follows: (a) October 14, 1980, as to 6,075 acre-feet of water per year; (b) February 22, 1983, as to 374 acre-feet of water per year; (c) November 15, 1985, as to 1,200 acre-feet of water per year; and (2) The time priority of GBRA's right to transfer 900 acre-feet of water per year for municipal purposes from the Guadalupe River Basin for use in the San Antonio River Basin is November 15, 1985. By this application, and based, in part, on GBRA's continued subordination of downstream senior hydroelectric water rights, the applicant requests that the Commission amend the Canyon Certificate as follows: (1) authorize GBRA to divert and use an average of 90,000 acre-feet of water per year over any five consecutive year period (450,000 acre-feet of water during any five consecutive calendar year period) from Canyon Reservoir, and delete the diversion and use limitation of 62,900 acre-feet of water in any year; (2) authorize the use of all water authorized to be diverted and used under the Canyon Certificate for municipal, domestic, industrial, irrigation and recreation purposes; (3) authorize the use of all water authorized to be diverted and used under the Canyon Certificate anywhere within GBRA's ten-county statutory district; (4) authorize the use, from and out of the water authorized to be diverted and used under the Canyon Certificate, of an average of 11,000 acre-feet of water per year (55,000 acre-feet of water during any five consecutive calendar-year period) from Canyon Reservoir anywhere outside GBRA's ten-county statutory district within the Guadalupe, San Antonio, Colorado, and Lavaca River Basins, and the Colorado-Lavaca, Lavaca-Guadalupe, and San Antonio-Nueces Coastal Basins; (5) delete the separate and duplicative transbasin diversion authorizations and their stated priority dates that existed prior to the granting of GBRA's most recent amendment to the Canyon Certificate, set forth above; and (6) confirm, expressly on the face of the amendment requested by this application, that the priority dates for the Canyon Certificate, as so amended, are as follows: (a) Except as set forth in subparagraph (b), below, the time priority of all rights under the Canyon Certificate as hereby amended is March 19, 1956. The time priority applies when inflows are impounded in Canyon Reservoir. (b) The time priority for impoundment of inflows in Canyon Reservoir shall be June 14, 1999 during times when the Reservoir would have been full if diversions of water were limited to an average of 50,000 acre-feet per year. No other changes are requested.

CAMP COOLEY, LTD., A Texas Limited Partnership, applicant, seeks an amendment pursuant to §11.122, Texas Water Code, and Texas Natural Resource Conservation Commission Rules 30 TAC §§295.1, et seq. Applicant seeks to amend Permit Number 5160 to allow diversion of 600 acre-feet of water per annum from impoundment for irrigation of any 300 acres of land within a 10,749 acre tract located in the Maria De La Concepcion Marques Survey, Abstract Number 25, the John Reid Survey, Abstract Number 318, the Ben C. Love Survey, Abstract Number 427, the Robert McCuistion Survey, Abstract Number 263, the Thomas Carr Survey, Abstract Number 428, the J. C. Evans Survey, Abstract Number 263, and the C. F. Anderson Survey, Abstract Number 58, Volume 569, pages 100-129, Robertson County, Texas. The proposed diversion point is any point on the perimeter of Artesian Lake. The proposed maximum rate of diversion is 2.67 cfs.

Request for Nominations to Appoint Four Individuals to the Waste Reduction Advisory Committee

The Texas Natural Resource Conservation Commission (TNRCC/Commission) is soliciting nominations to fill four members of the thirteen member the Waste Reduction Advisory Committee. The TNRCC Commissioners, at an Agenda meeting, will consider candidates for the advisory committee. Nominations must be received by the TNRCC no later than 5:00 p.m. on August 31, 1999.

The Waste Reduction Advisory Committee (WRAC) was established by the 71st Texas Legislature in 1989 under the Texas Health and Safety Code, §361.0215 to advise the Commission on matters dealing with air, water, and waste pollution prevention and technical assistance programs.

The WRAC is composed of nine official members who offer a balanced representation of environmental and public interest groups and the regulated community. The four ex officio positions were established by the Commission in 1992 and 1995 to provide additional participation from local and regional government and state legislators. Nominations are being solicited for four of the nine official members of the committee.

The WRAC advises the commission on various activities including: the appropriate organization of state agencies and the financial and technical resources required to aid the state in its efforts to promote waste reduction and minimization; the development of public awareness programs on household hazardous waste programs; and the provision of technical assistance to local governments for development of waste management strategies.

The WRAC operates under the requirements of the Texas Administrative Code, Title 30, Part I, Chapter 5, entitled Advisory Committees. The WRAC meets a minimum of four times per year and as needed. Members may not miss three consecutive regularly scheduled meetings or more than half of all the regularly scheduled meetings in a one-year period. The meetings usually last one full day and are held at the TNRCC in Austin, Texas. Members may request travel reimbursement for expenses incurred to attend meetings. The WRAC must report in writing to the Commission a minimum of once per year, unless otherwise directed.

The TNRCC Commissioners invite nominations for the following four positions. Each nomination should include a brief cover letter and biographical summary which includes the individual's experience and qualifications and an agreement to serve on the committee.

Please submit nomination(s) for the following vacancies to maintain a balanced representation on the WRAC:

1. Three representatives from an environmental or public interest group; and

2. One representatives from the regulated community.

Announcement: The Texas Department of Protective and Regulatory Services (TDPRS) Community Initiatives Program Division (effective 9-1-99, will be known as the Prevention and Early Intervention Services Division) announces a Request for Proposals (RPF) for a contractor to provide administrative services to current TDPRS funded Healthy Families service providers. The RFP will be released August 18, 1999.

Brief Description of Services: The services to be purchased are provided to the stateþs Healthy Families service providers and encompass the following: technical assistance, including the development of various provider resource materials; a variety of types of training sessions and conferences; assistance in working toward self sufficiency, including accessing grant funding; implementation of a uniform data collection software system; and program evaluation and contractor self-assessment.

The overall goal of this technical assistance and support to the Healthy Families providers will be to strengthen the statewide program and enhance the services received by families.

Eligible Applicants: Eligible offerors include private non profit and for profit corporations, cities, counties, state agencies/entities, partnerships and individuals. Charitable community or religious organizations, as well as Historically Underutilized Businesses, are encouraged to submit proposals. Current TDPRS-funded Healthy Families service providers are not eligible to apply for this contract.

Limitations: Only one contract will be awarded under this RFP. Funding of the selected proposal will be dependent upon available federal and/or state appropriations. TDPRS reserves the right to reject any and all offers received in response to this RFP and to cancel this RFP if it is deemed in the best interest of TDPRS.

Deadline for Proposals, Term of Contract, and Amount of Award: Proposals will be due September 28, 1999, at 4:00 p.m. The effective dates of a contract awarded under this RFP will be November 1, 1999, through August 31, 2000, with a maximum amount of $175,000 being available to fund the contract during this fiscal period. On July 27, 1999, Southwestern Bell Telephone Company and Focal Communications Corporation, collectively referred to as applicants, filed a joint application for approval of an existing interconnection agreement under §252(i) of the federal Telecommunications Act of 1996, Public Law Number 104-104, 110 Statute 56, (codified as amended in scattered sections of 15 and 47 United States Code) (FTA) and the Public Utility Regulatory Act, Texas Utilities Code Annotated §§11.001-63.063 (Vernon 1998) (PURA). The joint application has been designated Docket Number 21177. The joint application and the underlying interconnection agreement are available for public inspection at the commission's offices in Austin, Texas.

The commission must act to approve the interconnection agreement within 35 days after it is submitted by the parties.

The commission finds that additional public comment should be allowed before the commission issues a final decision approving or rejecting the interconnection agreement. Any interested person may file written comments on the joint application by filing 13 copies of the comments with the commission's filing clerk. Additionally, a copy of the comments should be served on each of the applicants. The comments should specifically refer to Docket Number 21177. As a part of the comments, an interested person may request that a public hearing be conducted. The Texas A&M University System (A&M System) requests proposals from professional firms interested in representing the A&M System and its members in certain tax matters.

Description: The A&M System is composed of 19 members (including 9 institutions, 1 health science center, 1 administrative office and 8 state agencies) supported by legislative appropriations, tuition, fees, income from auxiliary enterprises, the Permanent University Fund, the Available University Fund, grants, gifts, sponsored research and other sources of revenues, all of which may be impacted by the Internal Revenue Code and Internal Revenue Service Treasury Regulations. For assistance with such issues, the A&M System will engage outside counsel for review of and advice regarding tax matters as they relate to higher education including, but not limited to, the following: unrelated business income tax; retirement programs; tax matters regarding compensation issues; nonresident alien tax issues; and personal income tax issues as they relate to donors.

The A&M System invites proposals in response to this Request for Proposal (RFP) from qualified firms for the provision of such legal and tax services under the direction and supervision of the A&M System Office of Budgets and Accounting.

Responses: Responses to this RFP should include at least the following information:

a description of the firm's or attorney's qualifications for performing the legal services, including the firm's past experience in tax-related matters and retirement plans as they relate specifically to institutions of higher education;

the names and experience of the attorneys who will be assigned to work on such matters;

the availability of the lead attorney and others assigned to the project;

a description of the firm's efforts to encourage and develop the participation of minorities and women in the provision of the firm's and legal services generally, and tax matters in particular;

fee information (either in the form of hourly rates for each partner, associate, paralegal and technical advisor who may be assigned to perform services to the A&M System, comprehensive flat fees, or other fee arrangements directly related to the achievement of specific goals and cost controls) and billable expenses;

a comprehensive description of the procedures to be used by the firm to supervise the provision of legal services in a timely and cost-effective manner;

representation that should it be selected by the A&M System to provide legal assistance in tax matters, the firm will enter into the attached "Outside Counsel Agreement"; and

confirmation of willingness to comply with policies, directives and guidelines of the A&M System and the Attorney General of the State of Texas. Qualified firms must be able to exhibit compliance with House Bill 1, 76th Legislature, Regular Session, Article IX, §9-6.33 concerning matters against the State of Texas or any of its agencies.

Format and Person to Contact: Three copies of the proposal are requested. The proposal should be typed, preferably double spaced, on 8 1/2 by 11 inch paper with all pages sequentially numbered, and either stapled or bound together. They should be sent by mail or delivered in person, marked on the envelope "Response to Request for Proposal" and addressed to B. J. Evaluation: Proposals sent in response to this RFP will be evaluated in light of several criteria. The criteria are expertise, availability of a lead attorney, prior experience in handling tax matters related to higher education, procedures for providing timely and cost-effective services, and reasonableness of fees. Although the fee structure and overall cost of this representation will be an extremely important factor in evaluating proposals submitted in response to this RFP, the successful firm(s) will clearly demonstrate exceptional expertise and experience with the federal tax matters made the subject of this RFP.

The University of Texas at Austin requests, pursuant to the provisions of the Government Code, Chapter 2254.029, the submission of proposals leading to the award of a contract for Consulting Services. The University's objective is to assess the Office of Human Resources through an external review of its organization, functions, and quality in accordance with the terms, conditions, and requirements set forth in this RFP.

An award for the services specified herein will be made following a procedure using competitive sealed proposals. Proposals will be opened publicly to identify the names of the RESPONDENTS, but will be afforded security sufficient to preclude disclosure of the contents of the proposal, including prices or other information, prior to award. After opening, an award may be made on the basis of the proposals initially submitted, without discussion, clarification, or modification, or on the basis of negotiation with any of the RESPONDENTS or, at UNIVERSITY'S sole option and discretion, UNIVERSITY may discuss or negotiate all elements of the proposal with selected RESPONDENTS which represent a competitive range of proposals. For purposes of negotiation, a competitive range of acceptable or potentially acceptable proposals may be established comprising the highest rated proposal(s). After the submission of a proposal but before making an award, UNIVERSITY may permit the offeror to revise the proposal in order to obtain the best final offer. UNIVERSITY may not disclose any information derived from the proposals submitted from competing offers in conducting such discussions. UNIVERSITY will provide each offeror with an equal opportunity for discussion and revision of proposals. Further action on proposals not included in the competitive range will be deferred pending an award, but UNIVERSITY reserves the right to include additional proposals in the competitive range if deemed in the best interest of UNIVERSITY. UNIVERSITY reserves the right to award a Contract for all or any portion of the requirements proposed by reason of this request, award multiple Contracts, or to reject any and all proposals if deemed to be in the best interests of UNIVERSITY and to re-solicit for proposals, or to reject any and all proposals if deemed to be in the best interests of UNIVERSITY and to temporarily or permanently abandon the procurement. If UNIVERSITY awards a contract, it will award the contract to the offeror whose proposal is the most advantageous to UNIVERSITY, considering price and the evaluation factors set forth in this RFP. The Texas Workers' Compensation Commission invites all qualified individuals and representatives of public health care facilities and other entities to apply for openings on the Medical Advisory Committee in accordance with the eligibility requirements of the Standards and Procedures for the Medical Advisory Committee. Each member must be knowledgeable and qualified regarding work-related injuries and diseases.

Commissioners for the Texas Workers' Compensation appoint the Medical Advisory Committee members, which is composed of 16 primary and 16 alternate members representing health care providers, employees, employers and the public.

The purpose and tasks of the Medical Advisory Commission are outlined in the Texas Workers' Compensation Act, §413.005, which includes advising the Commission's Medical Review Division on the development and administration of medical policies and guidelines.

The Medical Advisory Committee meets approximately once every six weeks. Members are not reimbursed for travel, per diem, or other expenses associated with Committee activities and meetings.

During a primary member's absence, an alternate member must attend meetings for the Medical Advisory Committee, subcommittees, and work groups to which the primary member is appointed. The alternate may attend all meetings and shall fulfill the same responsibilities as primary members, as established in the Standards and Procedures for the Medical Advisory Committee as adopted by the Commission.
