(24 TexReg 1572) contained an error,
which was corrected in the March 26, 1999, issue of the
Texas Register
(24 TexReg 2525). Section 181.14 is adopted without
changes as corrected, and therefore will not be republished.
New §181.14 requires the State Registrar, Bureau of Vital Statistics,
to determine the required items of information on certificates of death and
fetal death.
No comments were received on the proposal during the comment period.
The new section is adopted under Health and Safety Code, §191.003,
which provides the Board of Health (board) with the authority to adopt necessary
rules for collecting, recording, transcribing, compiling, and preserving vital
statistics; §193.001, which allows the department to prescribe the form
and content of death and fetal death certificates; and §12.001, which
provides the board with the authority to adopt rules for the performance of
every duty imposed by law on the board, the department, and the commissioner
of health.
This agency hereby certifies that the adoption has been reviewed
by legal counsel and found to be a valid exercise of the agency's legal authority.
