The Employees Retirement System of Texas (ERS), adopts amendments
to §§85.1, 85.3, 85.5, 85.7, and 85.13, concerning the Flexible
Benefits (Cafeteria Plan) Program without changes to the proposed text as
published in the November 7, 1997 issue of the
Texas Register
(22 TexReg 10922).
These rules are being amended to reflect the inclusion of the premium conversion
plan into the Uniform Group Insurance Program rules.
Premium conversion plan rules will be located in the Uniform Group Insurance
Program rules.
No comments were received regarding adoption of these amendments.
The amendments are adopted under Insurance Code, Article 3.50-2,
§4A, which provides the ERS with the authority to promulgate all rules
and regulations necessary to implement and to administer the Uniform Group
Insurance Program and the Flexible Benefits (Cafeteria Plan) Program.
This agency hereby certifies that the adoption has been reviewed
by legal counsel and found to be a valid exercise of the agency's legal authority.
