37 TAC §§4.31, 4.32, 4.34-4.36, 4.39-4.43, 4.46
The Texas Department of Public Safety adopts amendments to
§§4.31, 4.32, 4.34 - 4.36, 4.39 - 4.43, and 4.46, concerning parking
and traffic administration, without changes to the proposed text as published
in the November 26, 1996, issue of the
Texas Register
(21 TexReg 11444).
The justification for the amendments will be to ensure the public that
equitable and economical parking facilities for state employees, state officials,
and the visiting public are provided and violations are properly handled.
The amendments clarify the authority of the Texas Department of Public
Safety with regard to parking and traffic administration, and set forth changes
to the procedures for enforcement of parking and traffic rules, including
issuance of citations, and the towing and immobilization of vehicles.
No comments were received regarding adoption of the amendments.
The amendments are adopted pursuant to Texas Government Code,
§411.006(4), which provides the director with the authority to adopt
rules, subject to commission approval, considered necessary for the control
of the department.
This agency hereby certifies that the adoption has been reviewed
by legal counsel and found to be a valid exercise of the agency's legal authority.
